Upon the effective date of this act, Class D3 shall include\n\nthe following criminal offenses:\n\n1. Violation of the Oklahoma Agricultural Code, as provided for\n\nin Section 2-18 of Title 2 of the Oklahoma Statutes;\n\n2. Violation of the Oklahoma Farm Animal, Crop, and Research\n\nFacilities Protection Act, as provided for in Section 5-105 of Title\n\n2 of the Oklahoma Statutes;\n\n3. Removing tag from diseased animal, as provided for in\n\nSection 6-94 of Title 2 of the Oklahoma Statutes;\n\n4. Moving quarantined livestock, in the amount of One Thousand\n\nDollars ($1,000.00) or more, as provided for in Section 6-125 of\n\nTitle 2 of the Oklahoma Statutes;\n\n5. Ship or transport of livestock without health certification\n\nor permit, as provided for in Section 6-151 of Title 2 of the\n\nOklahoma Statutes;\n\n6. Ship or transport of livestock which originated from a\n\nquarantined area, as provided for in Section 6-151 of Title 2 of the\n\nOklahoma Statutes;\n\n7. Unlawful transport of livestock, as provided for in Section\n\n6-155 of Title 2 of the Oklahoma Statutes;\n\n8. Slaughter of animals not in compliance with the Oklahoma\n\nMeat Inspection Act, as provided for in Section 6-190 of Title 2 of\n\nthe Oklahoma Statutes;\n\n9. Unauthorized labeling of meat products, as provided for in\n\nSection 6-191 of Title 2 of the Oklahoma Statutes;\n\n10. Selling horsemeat for human consumption, as provided for in\n\nSection 6-192 of Title 2 of the Oklahoma Statutes;\n\n11. Bribing or accepting bribe by meat inspector, as provided\n\nfor in Section 6-194 of Title 2 of the Oklahoma Statutes;\n\n12. Selling or transporting carcasses not intended for human\n\nconsumption, as provided for in Section 6-197 of Title 2 of the\n\nOklahoma Statutes;\n\n13. Failing to register as a meat broker, as provided for in\n\nSection 6-199 of Title 2 of the Oklahoma Statutes;\n\n14. Selling or transporting dead, dying, or disabled animals,\n\nas provided for in Section 6-200 of Title 2 of the Oklahoma\n\nStatutes;\n\n15. Violation of Oklahoma Meat Inspection Act, as provided for\n\nin Section 6-207 of Title 2 of the Oklahoma Statutes;\n\n16. Selling poultry products with false label, as provided for\n\nin Section 6-258 of Title 2 of the Oklahoma Statutes;\n\n17. Violation of the Oklahoma Poultry Products Inspection Act,\n\nas provided for in Section 6-259 of Title 2 of the Oklahoma\n\nStatutes;\n\n18. Processing poultry not in compliance with the Oklahoma\n\nPoultry Products Inspection Act, as provided for in Section 6-260 of\n\nTitle 2 of the Oklahoma Statutes;\n\n19. Buy, sell, or transport poultry carcasses not intended for\n\nuse as human food, as provided for in Section 6-261 of Title 2 of\n\nthe Oklahoma Statutes;\n\n20. Interfere with poultry products inspector, as provided for\n\nin Section 6-262 of Title 2 of the Oklahoma Statutes;\n\n21. Violating regulations regarding the storage of poultry\n\nproducts, as provided for in Section 6-264 of Title 2 of the\n\nOklahoma Statutes;\n\n22. Release of feral swine upon public lands, as provided for\n\nin Section 6-611 of Title 2 of the Oklahoma Statutes;\n\n23. Misrepresentation of goods, as provided for in Section 9-37\n\nof Title 2 of the Oklahoma Statutes;\n\n24. Conduct livestock auction without bond, as provided for in\n\nSection 9-132 of Title 2 of the Oklahoma Statutes;\n\n25. Sale or advertisement of agricultural products with\n\nimproper description, as provided for in Section 11-2 of Title 2 of\n\nthe Oklahoma Statutes;\n\n26. Violation of any provision of the Oklahoma Scrap Metal\n\nDealers Act, third offense, as provided for in subsection A of\n\nSection 11-94 of Title 2 of the Oklahoma Statutes;\n\n27. Knowingly providing false information in violation of the\n\nOklahoma Scrap Metal Dealers Act, as provided for in subsection C of\n\nSection 11-94 of Title 2 of the Oklahoma Statutes;\n\n28. Purchasing or selling burnt copper material or copper wire,\nvision of the Oklahoma Scrap Metal\n\nDealers Act, third offense, as provided for in subsection A of\n\nSection 11-94 of Title 2 of the Oklahoma Statutes;\n\n27. Knowingly providing false information in violation of the\n\nOklahoma Scrap Metal Dealers Act, as provided for in subsection C of\n\nSection 11-94 of Title 2 of the Oklahoma Statutes;\n\n28. Purchasing or selling burnt copper material or copper wire,\n\nsecond or subsequent offense, as provided for in subsection D of\n\nSection 11-94 of Title 2 of the Oklahoma Statutes;\n\n29. Interfere with, molest, assault, or impede the progress of\n\nforest rangers or firefighters, as provided for in Section 16-6 of\n\nTitle 2 of the Oklahoma Statutes;\n\n30. Removal of timber from state lands, as provided for in\n\nSection 16-59 of Title 2 of the Oklahoma Statutes;\n\n31. Cut down, injure, or destroy trees, as provided for in\n\nSection 16-60 of Title 2 of the Oklahoma Statutes;\n\n32. Fictitious, false, or fraudulent offer, agreement, or\n\ncontract for timber, as provided for in Section 16-63 of Title 2 of\n\nthe Oklahoma Statutes;\n\n33. False identification used in sale of timber, as provided\n\nfor in Section 16-66 of Title 2 of the Oklahoma Statutes;\n\n34. Install nonconforming fuel tank on aircraft, as provided\n\nfor in subsection A of Section 281 of Title 3 of the Oklahoma\n\nStatutes;\n\n35. Possess aircraft with nonconforming fuel tank on aircraft,\n\nas provided for in subsection B of Section 281 of Title 3 of the\n\nOklahoma Statutes;\n\n36. Testify falsely under oath before the Oklahoma Horse Racing\n\nCommission, as provided for in subsection C of Section 203.6 of\n\nTitle 3A of the Oklahoma Statutes;\n\n37. Multiple violations of Amusement and Carnival Games Act, as\n\nprovided for in subsection A of Section 504 of Title 3A of the\n\nOklahoma Statutes;\n\n38. Stray Animal Act violation, as provided for in Section\n\n85.11 of Title 4 of the Oklahoma Statutes;\n\n39. Willful political contributions by banks, as provided for\n\nin subsection B of Section 808 of Title 6 of the Oklahoma Statutes;\n\n40. Unlawful use of special assessment funds, as provided for\n\nin Section 39-113 of Title 11 of the Oklahoma Statutes;\n\n41. False affidavit as to value of real estate, as provided for\n\nin Section 65 of Title 12 of the Oklahoma Statutes;\n\n42. Swearing falsely in making an affidavit in forma pauperis,\n\nas provided for in Section 923 of Title 12 of the Oklahoma Statutes;\n\n43. Maintaining bucket shop dealing in commodity futures, as\n\nprovided for in Section 567 of Title 15 of the Oklahoma Statutes;\n\n44. Violation of the control of Rural Electric Cooperative Act,\n\nas provided in Section 158.59 of Title 17 of the Oklahoma Statutes;\n\n45. Violation of restricting, acquisition, control, or merger\n\nof Domestic Public Utilities Act, as provided for in Section 191.11\n\nof Title 17 of the Oklahoma Statutes;\n\n46. Violation of the Oklahoma Savings and Loans Code, as\n\nprovided for in Section 381.73 of Title 18 of the Oklahoma Statutes;\n\n47. Election officer or commissioner refuses to perform duties,\n\nas provided for in Section 28 of Title 19 of the Oklahoma Statutes;\n\n48. Bribery to influence voter, as provided for in Section 29\n\nof Title 19 of the Oklahoma Statutes;\n\n49. Bribery to influence voter, as provided for in Section 92\n\nof Title 19 of the Oklahoma Statutes;\n\n50. Violation of responsibilities by county treasurer, as\n\nprovided for in Section 112 of Title 19 of the Oklahoma Statutes;\n\n51. Use of bank in county in which treasurer or commissioner\n\nhas interest, as provided for in Section 123 of Title 19 of the\n\nOklahoma Statutes;\n\n52. Candidate contribution violation, as provided for in\n\nSection 187.1 of Title 21 of the Oklahoma Statutes;\n\n53. Contributions by corporation, as provided for in Section\n\n187.2 of Title 21 of the Oklahoma Statutes;\n\n54. Acceptance of gratuity or reward for appointment or\n\nexercise of office, as provided for in Section 275 of Title 21 of\n\nthe Oklahoma Statutes;\nitle 19 of the\n\nOklahoma Statutes;\n\n52. Altering draft bill, as provided for in Section 306 of\n\nTitle 21 of the Oklahoma Statutes;\n\n57. Jurors, referees, arbitrators, umpires, or assessors\n\nreceiving bribes, as provided for in Section 384 of Title 21 of the\n\nOklahoma Statutes;\n\n61. Receiving bribe for athletic contest, as provided for in\n\nSection 400 of Title 21 of the Oklahoma Statutes;\n\n62. Assisting prisoner to escape, as provided for in Section\n\n437 of Title 21 of the Oklahoma Statutes;\n\n63. Carry into prison things to aid escape, as provided for in\n\nSection 438 of Title 21 of the Oklahoma Statutes;\n\n64. Removing electronic monitoring device, as provided for in\n\nsubsection D of Section 444 of Title 21 of the Oklahoma Statutes;\n\n65. Offering false evidence, as provided for in Section 451 of\n\nTitle 21 of the Oklahoma Statutes;\n\n66. Violation of child custody order, as provided for in\n\nSection 567A of Title 21 of the Oklahoma Statutes;\n\n67. Communicate false information on missing child, as provided\n\nfor in subsection B of Section 589 of Title 21 of the Oklahoma\n\nStatutes;\n\n68. Fail to maintain public financial or business records, as\n\nprovided for in Section 590 of Title 21 of the Oklahoma Statutes;\n\n69. Aiding attempted suicide, as provided for in Section 815 of\n\nTitle 21 of the Oklahoma Statutes;\n\n70. Contributing to the delinquency of a minor, second or\n\nsubsequent offense, as provided for in subsection B of Section 856\n\nof Title 21 of the Oklahoma Statutes;\n\n71. Receiving money to aid person from arrest, as provided for\n\nin Section 950 of Title 21 of the Oklahoma Statutes;\n\n72. Betting on races, as provided for in subsection A of\n\nSection 991 of Title 21 of the Oklahoma Statutes;\n\n73. Preparing or drawing lottery, as provided for in Section\n\n1053 of Title 21 of the Oklahoma Statutes;\n\n74. Setting up lottery selling plan, as provided for in Section\n\n1066 of Title 21 of the Oklahoma Statutes;\n\n75. Injunction, as provided for in Section 1067 of Title 21 of\n\nthe Oklahoma Statutes;\n\n76. Pawnbroker refusing to exhibit stolen goods, as provided\n\nfor in Section 1092 of Title 21 of the Oklahoma Statutes;\n\n77. Interference with places of burial, as provided for in\n\nSection 1163 of Title 21 of the Oklahoma Statutes;\n\n78. Buying or selling human skeletal remains, as provided for\n\nin Section 1168.1 of Title 21 of the Oklahoma Statutes;\n\n79. Knowingly disturbing human skeletal remains, as provided\n\nfor in subsection C of Section 1168.4 of Title 21 of the Oklahoma\n\nStatutes;\n\n80. Disturbing burial ground with intent to obtain human\n\nskeletal remains, as provided for in subsection D of Section 1168.4\n\nof Title 21 of the Oklahoma Statutes;\n\n81. Burning a cross, as provided for in Section 1174 of Title\n\n21 of the Oklahoma Statutes;\n\n82. Unlawful use of police radio, as provided for in Section\n\n1214 of Title 21 of the Oklahoma Statutes;\n\n83. Organize groups advocating or encouraging overthrow of the\n\ngovernment of the United States or of Oklahoma, as provided for in\nsubsection D of Section 1168.4\n\nof Title 21 of the Oklahoma Statutes;\n\n81. Burning a cross, as provided for in Section 1174 of Title\n\n21 of the Oklahoma Statutes;\n\n82. Unlawful use of police radio, as provided for in Section\n\n1214 of Title 21 of the Oklahoma Statutes;\n\n83. Organize groups advocating or encouraging overthrow of the\n\ngovernment of the United States or of Oklahoma, as provided for in\n\nSection 1267.1 of Title 21 of the Oklahoma Statutes;\n\n84. Carry or use of slung shot, as provided for in Section 1282\n\nof Title 21 of the Oklahoma Statutes;\n\n85. Unlawful delivery of goods valued from One Thousand Dollars\n\n($1,000.00) to Two Thousand Five Hundred Dollars ($2,500.00), as\n\nprovided for in Section 1416 of Title 21 of the Oklahoma Statutes;\n\n86. Possess burglary tools by convicted burglar, as provided\n\nfor in Section 1442 of Title 21 of the Oklahoma Statutes;\n\n87. Mock auction, as provided for in Section 1506 of Title 21\n\nof the Oklahoma Statutes;\n\n91. Receiving money or property by impersonating another, value\n\nfrom One Thousand Dollars ($1,000.00) to Two Thousand Five Hundred\n\nDollars ($2,500.00), as provided for in Section 1532 of Title 21 of\n\nthe Oklahoma Statutes;\n\n92. False impersonation of public official or law enforcement\n\nofficer, as provided for in subsection B of Section 1533 of Title 21\n\nof the Oklahoma Statutes;\n\n93. Falsely asserting authority of the law, as provided for in\n\nsubsection C of Section 1533 of Title 21 of the Oklahoma Statutes;\n\n94. Intimidating public official or law enforcement officer, as\n\nprovided for in subsection D of Section 1533 of Title 21 of the\n\nOklahoma Statutes;\n\n95. False impersonation of judge, magistrate, court clerk,\n\nnotary public, or juror, as provided for in subsection E of Section\n\n1533 of Title 21 of the Oklahoma Statutes;\n\n96. False pretense, bogus check, or con game, value from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in subsection A of Section 1541.2 of\n\nTitle 21 of the Oklahoma Statutes;\n\n97. Two or more bogus checks, value from Two Thousand Dollars\n\n($2,000.00) to Two Thousand Five Hundred Dollars ($2,500.00), as\n\nprovided for in subsection A of Section 1541.3 of Title 21 of the\n\nOklahoma Statutes;\n\n98. Obtaining money, property, or signature under false\n\npretenses, as provided for in subsection A of Section 1542 of Title\n\n21 of the Oklahoma Statutes;\n\n99. Obtaining property by false retail sales receipt or label,\n\nas provided for in subsection B of Section 1542 of Title 21 of the\n\nOklahoma Statutes;\n\n100. Forgery II or Forgery III, value from One Thousand Dollars\n\n($1,000.00) to Two Thousand Five Hundred Dollars ($2,500.00), as\n\nprovided for in subsection A of Section 1577 of Title 21 of the\n\nOklahoma Statutes;\n\n103. Possession of forged evidence of debt, value from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in subsection A of Section 1578 of\n\nTitle 21 of the Oklahoma Statutes;\n\n104. Possession of other forged instrument, value from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\nn 1577 of Title 21 of the\n\nOklahoma Statutes;\n\n103. Possession of forged evidence of debt, value from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in subsection A of Section 1578 of\n\nTitle 21 of the Oklahoma Statutes;\n\n104. Receive, possess, or conceal stolen property, value from\n\nOne Thousand Dollars ($1,000.00) to Two Thousand Five Hundred\n\nDollars ($2,500.00), as provided for in subsection A of Section 1713\n\nof Title 21 of the Oklahoma Statutes;\n\n111. Bringing stolen property into state, valued from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in Section 1715 of Title 21 of the\n\nOklahoma Statutes;\n\n112. Larceny of domestic animals, as provided for in subsection\n\nB of Section 1716 of Title 21 of the Oklahoma Statutes;\n\n113. Larceny of dogs, as provided for in Section 1718 of Title\n\n21 of the Oklahoma Statutes;\n\n114. Larceny of merchandise from retailer, valued from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in subsection A of Section 1731 of\n\nTitle 21 of the Oklahoma Statutes;\n\n115. Larceny of trade secrets, value from One Thousand Dollars\n\n($1,000.00) to Two Thousand Five Hundred Dollars ($2,500.00), as\n\nprovided for in Section 1732 of Title 21 of the Oklahoma Statutes;\n\n116. Injury to highway, as provided for in Section 1753 of\n\nTitle 21 of the Oklahoma Statutes;\n\n117. Defaces, steals, or possesses road sign or marker and\n\nresults in personal injury or death, as provided for in Section\n\n1753.8 of Title 21 of the Oklahoma Statutes;\n\n118. Injure or destroy turnpike gate, as provided for in\n\nSection 1755 of Title 21 of the Oklahoma Statutes;\n\n119. Malicious injury or destruction of property, valued One\n\nThousand Dollars ($1,000.00) or more, as provided for in subsection\n\nA of Section 1760 of Title 21 of the Oklahoma Statutes;\n\n120. Malicious injury or destruction of property, two (2) or\n\nmore prior convictions regardless of amount, as provided for in\n\nsubsection A of Section 1760 of Title 21 of the Oklahoma Statutes;\n\n121. Defacing or injuring house of worship, as provided for in\n\nSection 1765 of Title 21 of the Oklahoma Statutes;\n\n122. Maliciously injuring written instrument, valued from One\n\nThousand Dollars ($1,000.00) to Two Thousand Five Hundred Dollars\n\n($2,500.00), as provided for in Section 1779 of Title 21 of the\n\nOklahoma Statutes;\n\n123. Injuring works of literature or art in public place, as\n\nprovided for in Section 1785 of Title 21 of the Oklahoma Statutes;\n\n124. Injuring pipes or wire, as provided for in Section 1786 of\n\nTitle 21 of the Oklahoma Statutes;\n\n125. Damaging fences used for production or containment of\n\nanimals, second or subsequent offense, as provided for in Section\n\n1791 of Title 21 of the Oklahoma Statutes;\n123. Injuring works of literature or art in public place, as\n\nprovided for in Section 1785 of Title 21 of the Oklahoma Statutes;\n\n124. Injuring pipes or wire, as provided for in Section 1786 of\n\nTitle 21 of the Oklahoma Statutes;\n\n125. Damaging fences used for production or containment of\n\nanimals, second or subsequent offense, as provided for in Section\n\n1791 of Title 21 of the Oklahoma Statutes;\n\n126. Willful trespass with intent to willfully damage, destroy,\n\nvandalize, deface, tamper with, impede, or inhibit, as provided for\n\nin subsection A of Section 1792 of Title 21 of the Oklahoma\n\nStatutes;\n\n127. Trespass and damage to critical infrastructure facility,\n\nas provided for in subsection B of Section 1792 of Title 21 of the\n\nOklahoma Statutes;\n\n128. Removal or disposal of mortgaged property, value from One\n\nThousand Dollars ($1,000.00) or more, as provided for in Section\n\n1834 of Title 21 of the Oklahoma Statutes;\n\n129. Telephone solicitor fails to give name or affiliation,\n\nthird or subsequent offense, as provided for in subsection A of\n\nSection 1861 of Title 21 of the Oklahoma Statutes;\n\n130. Violation of Oklahoma Solicitation of Charitable\n\nContributions Act, third or subsequent offense, as provided for in\n\nsubsection B of Section 1861 of Title 21 of the Oklahoma Statutes;\n\n131. Using telecommunication device with intent to defraud,\n\nvalue more than One Thousand Dollars ($1,000.00), as provided for in\n\nsubsection B of Section 1871 of Title 21 of the Oklahoma Statutes;\n\n132. Using a cloned cellular device to facilitate the\n\ncommission of a felony, as provided for in subsection C of Section\n\n1871 of Title 21 of the Oklahoma Statutes;\n\n133. Possessing five (5) or more unlawful telecommunication\n\ndevices, as provided for in subsection B of Section 1872 of Title 21\n\nof the Oklahoma Statutes;\n\n134. Possessing instrument capable of intercepting electronic\n\nserial number with intent to clone, as provided for in subsection C\n\nof Section 1872 of Title 21 of the Oklahoma Statutes;\n\n135. Selling unlawful telecommunication device, as provided for\n\nin subsection A of Section 1873 of Title 21 of the Oklahoma\n\nStatutes;\n\n136. Manufacturing unlawful telecommunication device, as\n\nprovided for in subsection A of Section 1874 of Title 21 of the\n\nOklahoma Statutes;\n\n137. Illegal profit by water conservancy district official, as\na\n\nStatutes;\n\n214. Impersonating member or veteran of the Armed Forces by\n\nwearing medals, as provided for in subsections B and C of Section 6-\n\n1 of Title 72 of the Oklahoma Statutes;\n\n215. State Auditor and Inspector or any deputy or employee\n\nmaking false report, as provided for in Section 217 of Title 74 of\n\nthe Oklahoma Statutes;\n\n216. Illegal profit by water conservancy district official, as\n\nprovided for in Section 674 of Title 82 of the Oklahoma Statutes;\n\nand\n\n217. Provide false information to secure self-insurance permit,\n\nas provided for in Section 38 of Title 85A of the Oklahoma Statutes.\n\nB. Any person convicted of a Class D3 criminal offense set\n\nforth in this section shall be punished by imprisonment in the\n\ncustody of the Department of Corrections for a term of not more than\n\ntwo (2) years and shall serve at least ten percent (10%) of the\n\nsentence imposed before release from custody including release to\n\nelectronic monitoring pursuant to Section 510.9 of Title 57 of the\n\nOklahoma Statutes.\n\nC. 1. Every person who, having been previously convicted of\n\none or two Class C or Class D criminal offenses, commits a Class D3\n\ncriminal offense shall, upon conviction, be punished by imprisonment\n\nin the custody of the Department of Corrections for a term of not\n\nless than one (1) year nor more than four (4) years and shall serve\n\nat least ten percent (10%) of the sentence imposed before release\n\nfrom custody including release to electronic monitoring pursuant to\n\nSection 510.9 of Title 57 of the Oklahoma Statutes.\n\n2. Every person who, having been previously convicted of three\n\nClass C or Class D criminal offenses, or one or more Class Y, Class\n\nA, or Class B criminal offenses, commits a Class D3 criminal offense\n\nshall, upon conviction, be punished by imprisonment in the custody\n\nof the Department of Corrections for a term of not less than one (1)\n\nyear nor more than ten (10) years and shall serve at least twenty\n\npercent (20%) of the sentence imposed before release from custody\n\nincluding release to electronic monitoring pursuant to Section 510.9\n\nof Title 57 of the Oklahoma Statutes.\n\nD. Unless specifically exempted pursuant to subsection E of\n\nthis section, Section 51.1 of Title 21 of the Oklahoma Statutes\n\nshall not apply to Class D3 criminal offenses.\n\nE. The criminal offenses listed in paragraphs 69, 124, 127, and\n\n177 of subsection A of this section shall be exempt from the penalty\n\nprovisions provided for in subsections B and C of this section.\n\nPersons convicted of the criminal offenses provided for in\n\nparagraphs 69, 124, 127, and 177 of subsection A of this section\n\nshall be punished in accordance with the corresponding penalties\n\nprovided for in the Oklahoma Statutes including Section 51.1 of\n\nTitle 21 of the Oklahoma Statutes.\n\nF.
