Stat. tit. 21, § 21-341","heading":"Embezzlement and false accounts by officers","body":"Every public officer of the state or any county, city, town, or\n\nmember or officer of the Legislature, and every deputy or clerk of\n\nany such officer and every other person receiving any money or other\n\nthing of value on behalf of or for account of this state or any\n\ndepartment of the government of this state or any bureau or fund\n\ncreated by law and in which this state or the people thereof, are\n\ndirectly or indirectly interested, who either:\n\nFirst: Receives, directly or indirectly, any interest, profit\n\nor perquisites, arising from the use or loan of public funds in the\n\nofficer’s or person’s hands or money to be raised through an agency\n\nfor state, city, town, district, or county purposes; or\n\nSecond: Knowingly keeps any false account, or makes any false\n\nentry or erasure in any account of or relating to any moneys so\n\nreceived by him, on behalf of the state, city, town, district or\n\ncounty, or the people thereof, or in which they are interested; or\n\nThird: Fraudulently alters, falsifies, cancels, destroys or\n\nobliterates any such account,\n\nshall, upon conviction thereof, be deemed guilty of a Class B3\n\nfelony offense and shall be punished by a fine of not to exceed Five\n\nHundred Dollars ($500.00), and by imprisonment in the State\n\nPenitentiary for a term of not less than one (1) year nor more than\n\ntwenty (20) years and, in addition thereto, the person shall be\n\ndisqualified to hold office in this state, and the court shall issue\n\nan order of such forfeiture, and should appeal be taken from the\n\njudgment of the court, the defendant may, in the discretion of the\n\ncourt, stand suspended from such office until such cause is finally\n\ndetermined.\n\nR.L. 1910, § 2581.
