Any person having been imprisoned in a county or city jail\n\nawaiting charges on a felony offense or prisoner awaiting trial or\n\nhaving been sentenced on a felony charge to the custody of the\n\nDepartment of Corrections or any other prisoner having been lawfully\n\ndetained who escapes from a county or city jail, either while\n\nactually confined therein, while permitted to be at large as a\n\ntrusty, or while awaiting transportation to a Department of\n\nCorrections facility for execution of sentence, shall be guilty of a\n\nClass D1 felony offense punishable by imprisonment as provided for\n\nin subsections B through F of Section 20N of this title.\n\nB. Any person who is an inmate in the custody of the Department\n\nof Corrections who escapes from said custody, either while actually\n\nconfined in a correctional facility, while assigned to an\n\nalternative to incarceration authorized by law, while assigned to\n\nthe Preparole Conditional Supervision Program as authorized by\n\nSection 365 of Title 57 of the Oklahoma Statutes or while permitted\n\nto be at large as a trusty, shall be guilty of a Class D1 felony\n\noffense punishable by imprisonment as provided for in subsections B\n\nthrough F of Section 20N of this title.\n\nC. For the purposes of this section, an inmate assigned to an\n\nalternative to incarceration authorized by law or to the Preparole\n\nConditional Supervision Program shall be considered to have escaped\n\nif the inmate cannot be located within a twenty-four hour period or\n\nif he or she fails to report to a correctional facility or\n\ninstitution, as directed. This includes any person escaping by\n\nabsconding from an electronic monitoring device or absconding after\n\nremoving an electronic monitoring device from their body.\n\nD. For the purposes of this section, if the individual who\n\nescapes has felony convictions for offenses other than the offense\n\nfor which the person was serving imprisonment at the time of the\n\nescape, those previous felony convictions may be used for\n\nenhancement of punishment pursuant to the provisions of Section 434\n\nof this title. The fact that any such convictions may have been\n\nused to enhance punishment in the sentence for the offense for which\n\nthe person was imprisoned at the time of the escape shall not\n\nprevent such convictions from being used to enhance punishment for\n\nthe escape.\n\nE. Any juvenile or youthful offender lawfully placed in a\n\njuvenile detention facility or secure juvenile facility, other than\n\na community intervention center, who escapes from the facility while\n\nactually confined therein, who escapes while escorted by a\n\ntransportation officer, or who escapes while permitted to be on an\n\nauthorized pass or work program outside the facility shall be guilty\n\nof a Class D1 felony offense punishable by imprisonment as provided\n\nfor in subsections B through F of Section 20N of this title. For\n\npurposes of this subsection:\n\n1. A juvenile or youthful offender permitted to be on an\n\nauthorized pass or work program shall be considered to have escaped\n\nif the juvenile or youthful offender cannot be located within a\n\ntwenty-four-hour period or if the juvenile or youthful offender\n\nfails to report to the facility at the specified time, and shall\n\ninclude any juvenile or youthful offender escaping by absconding\n\nfrom an electronic monitoring device or absconding after removing an\n\nelectronic monitoring device from the body of the juvenile or\n\nyouthful offender; and\n\n2. “Escape” means a juvenile or youthful offender in lawful\n\ncustody who has absented himself or herself without official\n\npermission from a facility or secure placement, during transport to\n\nor from such facility, or failure to return from a pass issued by a\n\nfacility.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3c0cd4f020a796748811d2e3d4e50e9adae5634764b32b124d2a407bee222d46","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-442","next":"us-ok/okla.-stat.-tit.-21-21-443a"},"notice":"GroundRules: Original legal text.
