It shall be unlawful for any executive, legislative,\n\nministerial or judicial officer to appoint or vote for the\n\nappointment of any person related to him by affinity or\n\nconsanguinity within the third degree, to any clerkship, office,\n\nposition, employment or duty in any department of the state,\n\ndistrict, county, city or municipal government of which such\n\nexecutive, legislative, ministerial or judicial officer is a member,\n\nwhen the salary, wages, pay or compensation of such appointee is to\n\nbe paid out of the public funds or fees of such office. Provided,\n\nhowever, that for the purposes of this chapter, a divorce of husband\n\nand wife shall terminate all relationship by affinity that existed\n\nby reason of the marriage, regardless of whether the marriage has\n\nresulted in issue who are still living.\n\nB. The provisions of this section shall not apply to any\n\nsituation covered by Section 5-113 of Title 70 of the Oklahoma\n\nStatutes.\n\nR.L. 1910, § 2235.
