Except as provided in this section and Section 979a of Title\n\n22 of the Oklahoma Statutes, for emergency medical treatment for an\n\ninjury or condition that threatens life or threatens the loss or use\n\nof a limb or where authorized personnel of the jail have deemed a\n\nperson medically unfit to be received into custody, any peace\n\nofficer or jail or prison contractor who, in violation of a duty\n\nimposed upon the officer or contractor by law or by contract to\n\nreceive into custody any person as a prisoner, willfully neglects or\n\nrefuses so to receive such person into custody is guilty of a\n\nmisdemeanor.\n\nB. Except as provided in this section and Section 979a of Title\n\n22 of the Oklahoma Statutes, for emergency medical treatment for an\n\ninjury or condition that threatens life or threatens the loss or use\n\nof a limb or where authorized personnel of the jail have deemed a\n\nperson medically unfit to be received into custody, any peace\n\nofficer or jail or prison contractor who, in violation of a duty\n\nimposed upon the officer or contractor by law or by contract to\n\nfingerprint any person received into custody as a prisoner,\n\nwillfully neglects or refuses so to fingerprint such person is\n\nguilty of a misdemeanor.\n\nC. Any person coming into contact with a peace officer prior to\n\nbeing actually received into custody at a jail facility or holding\n\nfacility, including, but not limited to, during the time of any\n\narrest, detention, transportation, investigation of any incident,\n\naccident or crime, who needs emergency medical treatment for an\n\ninjury or condition that threatens life or threatens the loss or use\n\nof a limb, shall be taken directly to a medical facility or hospital\n\nfor such emergency medical care notwithstanding any duty imposed\n\npursuant to this section or any other provision of law to first take\n\nsuch person into custody or to fingerprint such person. The\n\nresponsibility for payment of such emergency medical costs shall be\n\nthe sole responsibility of the person coming into the officer's\n\ncontact and shall not be the responsibility of any jail, law\n\nenforcement agency, jail or prison contractor, sheriff, peace\n\nofficer, municipality or county, except when the condition is a\n\ndirect result of injury caused by such officer acting outside the\n\nscope of lawful authority.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"cb76c9dcc026671f5c4c0d7b17b6f62bc7f4f1fb8a5179689e85303f5e18d3b6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-532","next":"us-ok/okla.-stat.-tit.-21-21-534"},"notice":"GroundRules: Original legal text.
