Stat. tit. 21, § 21-540B","heading":"Roadblocks","body":"A peace officer may set up one or more roadblocks to apprehend\n\nany person riding upon or within a motor vehicle traveling upon a\n\nhighway, street, turnpike, or area accessible to motoring public,\n\nwhen the officer has probable cause to believe such person is\n\ncommitting or has committed:\n\n1. A violation of Section 540A of this title;\n\n2. Escape from the lawful custody of any peace officer;\n\n3. A felony under the laws of this state or the laws of any\n\nother jurisdiction.\n\nA roadblock is defined as a barricade, sign, standing motor\n\nvehicle, or similar obstacle temporarily placed upon or adjacent to\n\na public street, highway, turnpike or area accessible to the\n\nmotoring public, with one or more peace officers in attendance\n\nthereof directing each operator of approaching motor vehicles to\n\nstop or proceed.\n\nAny operator of a motor vehicle approaching such roadblock has a\n\nduty to stop at the roadblock unless directed otherwise by a peace\n\nofficer in attendance thereof and the willful violation hereof shall\n\nconstitute a separate offense from any other offense committed. Any\n\nperson who willfully attempts to avoid such roadblock or in any\n\nmanner willfully fails to stop at such roadblock or who willfully\n\npasses by or through such roadblock without receiving permission\n\nfrom a peace officer in attendance thereto is guilty of a Class C2\n\nfelony offense and shall be punished by imprisonment as provided for\n\nin subsections B through F of Section 20M of this title, or by a\n\nfine not exceeding Five Thousand Dollars ($5,000.00), or by both\n\nsuch fine and imprisonment.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"aa0c5633559eb3e613041eb4941d28795b2186e460ec058024aa33d44a946bac","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-540av2","next":"us-ok/okla.-stat.-tit.-21-21-540c"},"notice":"GroundRules: Original legal text.
