Any parent or other person who violates an order of any\n\ncourt of this state granting the custody of a child under the age of\n\neighteen (18) years to any person, agency, institution, or other\n\nfacility, with the intent to deprive the lawful custodian of the\n\ncustody of the child shall, upon conviction, be guilty of a Class D3\n\nfelony offense and shall be punished by imprisonment as provided for\n\nin subsections B through F of Section 20P of this title. The fine\n\nfor a violation of this subsection shall not exceed Five Thousand\n\nDollars ($5,000.00).\n\nB. The offender shall have an affirmative defense if the\n\noffender reasonably believes that the act was necessary to preserve\n\nthe child from physical, mental, or emotional danger to the child’s\n\nwelfare and the offender notifies the local law enforcement agency\n\nnearest to the location where the custodian of the child resides.\n\nC. If a child is removed from the custody of the child’s lawful\n\ncustodian pursuant to the provisions of this section any law\n\nenforcement officer may take the child into custody without a court\n\norder and, unless there is a specific court order directing a law\n\nenforcement officer to take the child into custody and release or\n\nreturn the child to a lawful custodian, the child shall be held in\n\nemergency or protective custody pursuant to the provisions of\n\nSection 1-4-201 of Title 10A of the Oklahoma Statutes.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b5e93b33c3218b081f91ca187b7fdd6ac4bf42d4afc16d8d824e0960c321ca33","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-567","next":"us-ok/okla.-stat.-tit.-21-21-567b"},"notice":"GroundRules: Original legal text.
