As used in this section:\n\n1. \"Agent\" means any person who acts for another at the request\n\nor with the knowledge of the other in dealing with third persons;\n\nand\n\n2. \"Runner\", \"capper\", and \"steerer\" mean any person acting\n\nwithin this state for compensation as an agent for an attorney in\n\nthe solicitation of employment for the attorney.\n\nB. No attorney shall, by means of an agent, runner, capper,\n\nsteerer, or other person who is not an attorney, solicit or procure\n\na person to employ the attorney to present, compromise, or settle a\n\nclaim under the workers' compensation laws of this state.\n\nC. No attorney shall, directly or indirectly, pay or promise to\n\npay any person, other than another attorney, any money, service,\n\nfee, commission, or other thing of value in consideration for the\n\nemployment of the attorney to present, compromise, or settle a claim\n\nunder the workers' compensation laws of this state.\n\nD. No person shall act or agree to act as an agent, runner,\n\ncapper, or steerer for an attorney.\n\nE. Subsections B and C of this section shall not prohibit\n\nparticipation by an attorney in a voluntary attorney referral\n\nprogram including, but not limited to, referral programs operated by\n\nan association of attorneys. This subsection shall not authorize a\n\nreferral program which is otherwise unauthorized under the Rules of\n\nProfessional Conduct adopted by the Supreme Court.\n\nF. Any contract for employment of an attorney secured in\n\nviolation of this section shall be void and unenforceable and no\n\nattorney shall appear or otherwise provide services in an action in\n\nviolation of this section.\n\nG. Any person who violates the provisions of this section shall\n\nbe guilty of a misdemeanor and upon conviction shall be subject to a\n\nfine of up to Two Thousand Five Hundred Dollars ($2,500.00) for each\n\noffense, which shall not be subject to Section 101 of Title 85 of\n\nthe Oklahoma Statutes.
