As used in this section:\n\n1. \"Agent\" means any person who acts for another at the request\n\nor with the knowledge of the other in dealing with third persons;\n\n2. \"Medical care provider\" means any person licensed in\n\nOklahoma as a medical doctor, a chiropractor, a podiatrist, a\n\ndentist, an osteopathic physician or an optometrist or a hospital;\n\nand\n\n3. \"Runner\", \"capper\", and \"steerer\" mean any person acting\n\nwithin this state for compensation as an agent for a medical care\n\nprovider in the solicitation of a person to employ the medical care\n\nprovider to provide medical services.\n\nB. No medical care provider shall, by means of an agent,\n\nrunner, capper, steerer, or other person who is not a medical care\n\nprovider, solicit or procure a person to employ the medical care\n\nprovider to provide medical services under the workers' compensation\n\nlaws of this state.\n\nC. No medical care provider shall, directly or indirectly, pay\n\nor promise to pay any person, other than another medical care\n\nprovider, any money, service, fee, commission, or other thing of\n\nvalue in consideration for the employment of the medical care\n\nprovider to provide medical services under the workers' compensation\n\nlaws of this state.\n\nD. No person shall act or agree to act as an agent, runner,\n\ncapper, or steerer for a medical care provider.\n\nE. Subsections B and C of this section shall not prohibit\n\nparticipation by a medical care provider in a voluntary medical care\n\nprovider referral program including, but not limited to, referral\n\nprograms operated by an association of medical care providers.\n\nF. Any contract for employment of a medical care provider\n\nsecured in violation of this section shall be void and unenforceable\n\nand no medical care provider shall provide medical services in\n\nviolation of this section.\n\nG. Any person who violates the provisions of this section shall\n\nbe guilty of a misdemeanor and upon conviction shall be subject to a\n\nfine of up to Two Thousand Five Hundred Dollars ($2,500.00) for each\n\noffense, which shall not be subject to Section 101 of Title 85 of\n\nthe Oklahoma Statutes.
