Any person who commits domestic abuse, as defined by\n\nsubsection C of Section 644 of this title, and has a prior pattern\n\nof physical abuse shall be guilty of a Class B3 felony offense, upon\n\nconviction, punishable by imprisonment in the custody of the\n\nDepartment of Corrections for a term of not more than ten (10) years\n\nor by a fine not exceeding Five Thousand Dollars ($5,000.00) or by\n\nboth such fine and imprisonment.\n\nB. For purposes of this section, \"prior pattern of physical\n\nabuse\" means two or more separate incidences, including the current\n\nincident, occurring on different days and each incident relates to\n\nan act constituting assault and battery or domestic abuse committed\n\nby the defendant against a current or former spouse, a present\n\nspouse of a former spouse, parents, a foster parent, a child, a\n\nperson otherwise related by blood or marriage, a person with whom\n\nthe defendant is in a dating relationship, an individual with whom\n\nthe defendant has had a child, a person who formerly lived in the\n\nsame household as the defendant, a person living in the same\n\nhousehold as the defendant, a current intimate partner or former\n\nintimate partner, or any combination of such persons, where proof of\n\neach incident prior to the present incident is established by the\n\nsworn testimony of a third party who was a witness to the alleged\n\nphysical abuse or by other admissible direct evidence that is\n\nindependent of the testimony of the victim.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e46f99660176d0c06c2a7d3b8c158c9a5dc82171f7eca3214eec3a6bdbbcdbf5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-644","next":"us-ok/okla.-stat.-tit.-21-21-644v1"},"notice":"GroundRules: Original legal text.
