An assault and battery becomes aggravated when committed\n\nunder any of the following circumstances:\n\n1. When great bodily injury is inflicted upon the person\n\nassaulted; or\n\n2. When committed by a person of robust health or strength upon\n\none who is aged, decrepit, or incapacitated, as defined in Section\n\n641 of this title.\n\nB.
