Every person who, without justifiable or excusable cause,\n\nknowingly commits any assault upon the person of a police officer,\n\nsheriff, deputy sheriff, highway patrolman, corrections personnel,\n\nor state peace officer employed or duly appointed by any state\n\ngovernmental agency to enforce state laws while the officer is in\n\nthe performance of his or her duties is punishable by imprisonment\n\nin the county jail not exceeding six (6) months, or by a fine not\n\nexceeding Five Hundred Dollars ($500.00), or by both such fine and\n\nimprisonment.\n\nB. Every person who, without justifiable or excusable cause\n\nknowingly commits battery or assault and battery upon the person of\n\na police officer, sheriff, deputy sheriff, highway patrolman,\n\ncorrections personnel, or other state peace officer employed or duly\n\nappointed by any state governmental agency to enforce state laws\n\nwhile the officer is in the performance of his or her duties, upon\n\nconviction, shall be guilty of a Class B5 felony offense punishable\n\nby imprisonment in the custody of the Department of Corrections of\n\nnot more than five (5) years or county jail for a period not to\n\nexceed one (1) year, or by a fine not exceeding Five Hundred Dollars\n\n($500.00), or by both such fine and imprisonment.\n\nC. As used in this section and in Section 650 of this title,\n\n\"corrections personnel\" means any person, employed or duly appointed\n\nby the state or by a political subdivision, who has direct contact\n\nwith inmates of a jail or state correctional facility, and includes\n\nbut is not limited to, Department of Corrections personnel in job\n\nclassifications requiring direct contact with inmates, persons\n\nproviding vocational-technical training to inmates, education\n\npersonnel who have direct contact with inmates because of education\n\nprograms for inmates, and persons employed or duly appointed by\n\ncounty or municipal jails to supervise inmates or to provide medical\n\ntreatment or meals to inmates of jails.\n\nD. For the purposes of this section, assault and battery upon\n\nlaw officers includes any attempt to reach for or gain control of\n\nthe firearm of any police officer, sheriff, deputy sheriff, highway\n\npatrol, corrections personnel as defined in Section 649 of this\n\ntitle, or any peace officer employed by any state or federal\n\ngovernmental agency to enforce state laws.\n\nE. For purposes of this section, if an officer is off duty and\n\nthe nature of the assault or assault and battery relates back to, or\n\nin any manner or circumstances has to do with, his or her official\n\nposition as a law enforcement officer then it shall fall within the\n\nmeaning of \"in the performance of his or her duties\" as an officer.\n\nF.
