Stat. tit. 21, § 21-649.1","heading":"Striking, tormenting, and other mistreatment of a police","body":"dog or horse - Penalties - Restitution.\n\nA. No person shall willfully strike, torment, administer a\n\nnonpoisonous desensitizing substance to, or otherwise mistreat a\n\npolice dog or police horse owned, or the service of which is\n\nemployed, by a law enforcement agency of the state or a political\n\nsubdivision of the state.\n\nB. No person shall willfully interfere with the lawful\n\nperformance of any police dog or police horse.\n\nC. Except as provided in subsection D of this section, any\n\nperson convicted of violating any of the provisions of this section\n\nshall be guilty of a Class B6 felony offense, punishable by the\n\nimposition of a fine not exceeding Five Hundred Dollars ($500.00),\n\nor by imprisonment in the county jail not exceeding one (1) year, or\n\nby both such fine and imprisonment. In addition, the person shall\n\nbe ordered to pay restitution, which shall be paid to the law\n\nenforcement agency or political subdivision of the state which\n\nemployed the service of the police dog or horse.\n\nD. Any person who knowingly and willfully and without lawful\n\ncause or justification violates the provisions of this section,\n\nduring the commission of a misdemeanor or felony, shall be guilty of\n\na Class B5 felony offense, punishable by the imposition of a fine\n\nnot exceeding One Thousand Dollars ($1,000.00), or by imprisonment\n\nin the custody of the Department of Corrections not exceeding two\n\n(2) years, or by both such fine and imprisonment.
