Stat. tit. 21, § 21-649.2","heading":"Killing, disfiguring, disabling, and other acts","body":"committed against a police dog or horse - Penalties - Restitution -\n\nExceptions.\n\nA. No person shall willfully kill; beat; torture; injure so as\n\nto disfigure or disable; administer poison to; set a booby trap\n\ndevice for the purpose of injury so as to disfigure, disable or\n\nkill; or pay or agree to pay bounty for purposes of injury so as to\n\ndisfigure, disable or kill any police dog or police horse owned, or\n\nthe service of which is employed, by a law enforcement agency of the\n\nstate or a political subdivision of the state.\n\nB. Except as provided in subsection C of this section, any\n\nperson convicted of violating the provisions of this section is\n\nguilty of a misdemeanor punishable by the imposition of a fine not\n\nexceeding One Thousand Dollars ($1,000.00), or by imprisonment in\n\nthe county jail not exceeding one (1) year, or by both such fine and\n\nimprisonment. In addition, the person shall be ordered to pay\n\nrestitution, which shall be paid to the law enforcement agency or\n\npolitical subdivision of the state which employed the service of the\n\npolice dog or horse.\n\nC. Any person who knowingly and willfully and without lawful\n\ncause or justification violates the provisions of this section,\n\nduring the commission of a misdemeanor or felony, shall be guilty of\n\na Class B5 felony offense, punishable by the imposition of a fine\n\nnot exceeding One Thousand Dollars ($1,000.00), or by imprisonment\n\nin the custody of the Department of Corrections not exceeding five\n\n(5) years, or by both such fine and imprisonment. In addition, the\n\nperson shall be ordered to pay restitution, which shall be paid to\n\nthe law enforcement agency or political subdivision of the state\n\nwhich employed the service of the police dog or horse.\n\nD. The provisions of this section shall not apply:\n\n1. To a peace officer or veterinarian who terminates the life\n\nof a police dog or a police horse for the purpose of relieving the\n\ndog or horse of undue pain or suffering; or\n\n2.
