Medical battery is a Class B6 felony offense, upon\n\nconviction, punishable by imprisonment in the county jail for a term\n\nof not more than one (1) year, or imprisonment in the custody of the\n\nDepartment of Corrections for a term of not more than four (4)\n\nyears, and a fine in an amount not more than Five Thousand Dollars\n\n($5,000.00). In addition, the defendant shall be ordered to make\n\nrestitution to the victim in an amount as determined by the court.\n\nB. For purposes of this section, “medical battery” means:\n\n1. The defendant has been found guilty of practicing dentistry,\n\nmedicine, osteopathic medicine, or surgery, without a license or\n\nauthority as prohibited by the provisions of the State Dental Act,\n\nthe Oklahoma Allopathic Medical and Surgical Licensure and\n\nSupervision Act, or the Oklahoma Osteopathic Medicine Act;\n\n2. The treatment, or course of treatment, practiced in\n\nviolation of the provisions of the State Dental Act, the Oklahoma\n\nAllopathic Medical and Surgical Licensure and Supervision Act, or\n\nthe Osteopathic Medicine Act resulted in the victim having permanent\n\nphysical injury or disfigurement;\n\n3. The victim consented to such treatment, or course of\n\ntreatment, under a belief that the defendant was licensed and\n\nauthorized to diagnose and perform the treatment; and\n\n4.
