Every person in the custody of the Oklahoma Department of\n\nCorrections who, without justifiable or excusable cause, knowingly\n\ncommits any assault, battery or assault and battery upon the person\n\nof a Department of Corrections employee while said employee is in\n\nthe performance of his or her duties shall, upon conviction thereof,\n\nbe guilty of a Class B6 felony offense.\n\nB. Every person incarcerated in an institution operated by a\n\nprivate prison contractor, pursuant to Section 561, 563.1 or 563.2\n\nof Title 57 of the Oklahoma Statutes, who, without justifiable or\n\nexcusable cause, knowingly commits any assault, battery or assault\n\nand battery upon the person of an employee of the contractor while\n\nsaid employee is in the performance of duties shall, upon conviction\n\nthereof, be guilty of a Class B6 felony offense.\n\nC. Every person in the custody of the Department of Human\n\nServices who, without justifiable or excusable cause, knowingly\n\ncommits any aggravated assault and battery upon the person of a\n\nDepartment of Human Services employee, or a person contracting with\n\nthe Department to provide services, while the employee or contractor\n\nis in the performance of his or her duties shall, upon conviction\n\nthereof, be guilty of a Class B6 felony offense.\n\nD. Every person in the custody of the Office of Juvenile\n\nAffairs who, without justifiable or excusable cause, knowingly\n\ncommits any assault, battery or assault and battery upon the person\n\nof an Office of Juvenile Affairs employee while said employee is in\n\nthe performance of his or her duties shall, upon conviction thereof,\n\nbe guilty of a Class B6 felony offense.\n\nE. Every person in the custody of the Office of Juvenile\n\nAffairs who, without justifiable or excusable cause, knowingly\n\ncommits any battery or assault and battery resulting in bodily\n\ninjury to any employee of the Office of Juvenile Affairs or employee\n\nof any residential facility while said employee is in the\n\nperformance of duties of employment shall, upon conviction thereof,\n\nbe guilty of a Class B5 felony offense.
