Every person who, without justifiable or excusable cause and\n\nwith intent to do bodily harm, commits any aggravated assault and\n\nbattery or any assault with a firearm or other deadly weapon upon\n\nthe person of a medical care provider, upon conviction, is guilty of\n\na Class D2 felony offense punishable by imprisonment in the custody\n\nof the Department of Corrections for a term not less than two (2)\n\nyears nor more than five (5) years, or by a fine not to exceed One\n\nThousand Dollars ($1,000.00), or by both such fine and imprisonment.\n\nAny subsequent conviction pursuant to this section shall be a Class\n\nD2 felony offense, punishable by imprisonment as provided for in\n\nsubsection C of Section 20O of this title.\n\nB.
