Stat. tit. 21, § 21-650.7","heading":"Assault, battery, or assault and battery upon school","body":"employee or student – Notice - Definition.\n\nA. As used in this section, “school employee\" means a teacher,\n\nprincipal, or any duly appointed person employed by a school system\n\nor employees of a firm contracting with a school system for any\n\npurpose, including any personnel not directly related to the\n\nteaching process and school board members during school board\n\nmeetings.\n\nB. Any person who, without justifiable or excusable cause,\n\ncommits any assault, battery, or assault and battery upon the person\n\nof a school employee while such employee is in the performance of\n\nany duties as a school employee or upon any student while such\n\nstudent is participating in any school activity or attending classes\n\non school property during school hours shall, upon conviction, be\n\nguilty of a misdemeanor. The convicted person shall be punished by\n\na term of imprisonment in the county jail for a period not exceeding\n\none (1) year, or by a fine not exceeding Two Thousand Dollars\n\n($2,000.00), or by both such fine and imprisonment.\n\nC. Any person who, without justifiable or excusable cause,\n\ncommits any aggravated battery or aggravated assault and battery\n\nupon the person of a school employee while such employee is in the\n\nperformance of any duties as a school employee shall, upon\n\nconviction, be guilty of a Class B6 felony offense punishable by a\n\nterm of imprisonment in the State Penitentiary for a period not\n\nexceeding two (2) years, or by a fine not exceeding Five Thousand\n\nDollars ($5,000.00), or by both such fine and imprisonment.\n\nD. Every school site shall post in a prominent place a notice\n\nhaving the following or similar language: “FELONY CHARGES MAY BE\n\nFILED AGAINST ANY PERSON(S) COMMITTING AN AGGRAVATED ASSAULT OR\n\nBATTERY UPON ANY SCHOOL EMPLOYEE.”\n\nE.
