Every person who, without justifiable or excusable cause,\n\nknowingly commits any aggravated assault and battery upon the person\n\nof a police officer, sheriff, deputy sheriff, highway patrolman,\n\ncorrections personnel as defined in Section 649 of this title, or\n\nany state peace officer employed by any state or federal\n\ngovernmental agency to enforce state laws, while the officer is in\n\nthe performance of his or her duties shall, upon conviction, be\n\nguilty of a felony punishable by imprisonment in the custody of the\n\nDepartment of Corrections for not more than life, a fine not\n\nexceeding One Thousand Dollars ($1,000.00), or by both such fine and\n\nimprisonment.\n\nB. Every person who, without justifiable or excusable cause,\n\ncommits any aggravated assault and battery upon a person that the\n\nviolator knows or should reasonably know is a police officer,\n\nsheriff, deputy sheriff, highway patrolman, corrections personnel as\n\ndefined in Section 649 of this title, or any state peace officer\n\nemployed by any state or federal governmental agency to enforce\n\nstate laws, that results in maiming as defined in Section 751 of\n\nthis title, while the officer is in the performance of his or her\n\nduties shall, upon conviction, be guilty of a felony punishable by\n\nimprisonment in the custody of the Department of Corrections for not\n\nless than five (5) years nor more than life, a fine not exceeding\n\nFive Thousand Dollars ($5,000.00), or by both such fine and\n\nimprisonment.\n\nC. For purposes of this section, aggravated assault and battery\n\nupon law officers includes:\n\n1. The physical contact with and an attempt to gain control of\n\nthe firearm; or\n\n2. The strangulation,\n\nof any police officer, sheriff, deputy sheriff, highway patrolman,\n\ncorrections personnel as defined in Section 649 of this title, or\n\nany peace officer employed by any state or federal governmental\n\nagency to enforce state laws.\n\nAs used in this subsection, “strangulation” shall have the same\n\nmeaning as provided in subsection J of Section 644 of this title.\n\nD.
