Every person who, without justifiable or excusable cause,\n\nknowingly commits any aggravated assault and battery upon the person\n\nof a police officer, sheriff, deputy sheriff or highway patrolman,\n\ncorrections personnel as defined in Section 649 of this title, or\n\nany state peace officer employed by any state or federal\n\ngovernmental agency to enforce state laws, while the officer is in\n\nthe performance of his or her duties shall upon conviction thereof\n\nbe guilty of a Class A3 felony offense, which shall be punishable by\n\nimprisonment in the custody of the Department of Corrections for not\n\nmore than life or by a fine not exceeding One Thousand Dollars\n\n($1,000.00), or by both such fine and imprisonment.\n\nB. Every person who, without justifiable or excusable cause,\n\ncommits any aggravated assault and battery upon a person that the\n\nviolator knows or should reasonably know is a police officer,\n\nsheriff, deputy sheriff or highway patrolman, corrections personnel\n\nas defined in Section 649 of this title, or any state peace officer\n\nemployed by any state or federal governmental agency to enforce\n\nstate laws, that results in maiming as defined in Section 751 of\n\nthis title, while the officer is in the performance of his or her\n\nduties shall, upon conviction, be guilty of a Class A2 felony\n\noffense punishable by imprisonment in the custody of the Department\n\nof Corrections of not less than five (5) years nor more than life or\n\nby a fine not exceeding Five Thousand Dollars ($5,000.00), or by\n\nboth such fine and imprisonment.\n\nC. For purposes of this section, aggravated assault and battery\n\nupon law officers includes the physical contact with and in attempt\n\nto gain control of the firearm of any police officer, sheriff,\n\ndeputy sheriff, highway patrolman, corrections personnel as defined\n\nin Section 649 of this title, or any peace officer employed by any\n\nstate or federal governmental agency to enforce state laws.\n\nD.
