Any person who is guilty of an assault with intent to commit\n\nany felony, except an assault with intent to kill, the punishment\n\nfor which assault is not otherwise prescribed in this code, shall be\n\nguilty of a Class B5 felony offense punishable by imprisonment in\n\nthe custody of the Department of Corrections not exceeding five (5)\n\nyears, or in a county jail not exceeding one (1) year, or by a fine\n\nnot exceeding Five Hundred Dollars ($500.00), or by both such fine\n\nand imprisonment.\n\nB. Except for persons sentenced to life or life without parole,\n\nany person sentenced to imprisonment for two (2) years or more for a\n\nviolation of subsection A of this section and the offense involved\n\nsexual assault, shall be required to serve a term of post-\n\nimprisonment supervision pursuant to subparagraph f of paragraph 1\n\nof subsection A of Section 991a of Title 22 of the Oklahoma Statutes\n\nunder conditions determined by the Department of Corrections. The\n\njury shall be advised that the mandatory post-imprisonment\n\nsupervision shall be in addition to the actual imprisonment.\n\nR.L. 1910, § 2338. Amended by Laws 1997, c. 133, § 232, eff.
