Upon conviction or adjudication of guilt of a defendant of\n\nmurder in the first degree, wherein the state is not seeking the\n\ndeath penalty but has alleged that the defendant has prior felony\n\nconvictions, the court shall conduct a separate sentencing\n\nproceeding to determine whether the defendant should be sentenced to\n\nlife imprisonment without parole or life imprisonment, wherein the\n\nstate shall be given the opportunity to prove any prior felony\n\nconvictions beyond a reasonable doubt. The proceeding shall be\n\nconducted by the trial judge before the same trial jury as soon as\n\npracticable without presentence investigation.\n\nB.
