Stat. tit. 21, § 21-701.11","heading":"Instructions - Jury findings of aggravating","body":"circumstance.\n\nIn the sentencing proceeding, the statutory instructions as\n\ndetermined by the trial judge to be warranted by the evidence shall\n\nbe given in the charge and in writing to the jury for its\n\ndeliberation. The jury, if its verdict be a unanimous\n\nrecommendation of death, shall designate in writing, signed by the\n\nforeman of the jury, the statutory aggravating circumstance or\n\ncircumstances which it unanimously found beyond a reasonable doubt.\n\nIn nonjury cases the judge shall make such designation. Unless at\n\nleast one of the statutory aggravating circumstances enumerated in\n\nthis act is so found or if it is found that any such aggravating\n\ncircumstance is outweighed by the finding of one or more mitigating\n\ncircumstances, the death penalty shall not be imposed.
