Stat. tit. 21, § 21-701.12","heading":"Aggravating circumstances","body":"Aggravating circumstances shall be:\n\n1. The defendant was previously convicted of a felony involving\n\nthe use or threat of violence to the person;\n\n2. The defendant knowingly created a great risk of death to\n\nmore than one person;\n\n3. The person committed the murder for remuneration or the\n\npromise of remuneration or employed another to commit the murder for\n\nremuneration or the promise of remuneration;\n\n4. The murder was especially heinous, atrocious, or cruel;\n\n5. The murder was committed for the purpose of avoiding or\n\npreventing a lawful arrest or prosecution;\n\n6. The murder was committed by a person while serving a\n\nsentence of imprisonment on conviction of a felony;\n\n7. The existence of a probability that the defendant would\n\ncommit criminal acts of violence that would constitute a continuing\n\nthreat to society; or\n\n8.
