Stat. tit. 21, § 21-748v1","heading":"Human trafficking for forced labor or forced sexual","body":"exploitation.\n\nA. As used in Sections 748 and 748.2 of this title:\n\n1. \"Coercion\" means compelling, forcing or intimidating a\n\nperson to act by:\n\na. threats of harm or physical restraint against any\n\nperson,\n\nb. any act, scheme, plan, or pattern intended to cause a\n\nperson to believe that performing, or failing to\n\nperform, an act would result in serious physical,\n\nfinancial, or emotional harm or distress to or\n\nphysical restraint against any person,\n\nc. the abuse or threatened abuse of the law or legal\n\nprocess,\n\nd. knowingly destroying, concealing, removing,\n\nconfiscating or possessing any actual or purported\n\npassport, labor or immigration document, or other\n\ngovernment identification document, including but not\n\nlimited to a driver license or birth certificate, of\n\nanother person,\n\ne. facilitating or controlling a person's access to any\n\naddictive or controlled substance other than for legal\n\nmedical purposes,\n\nf. blackmail,\n\ng. demanding or claiming money, goods, or any other thing\n\nof value from or on behalf of a prostituted person\n\nwhere such demand or claim arises from or is directly\n\nrelated to the act of prostitution,\n\nh. determining, dictating or setting the times at which\n\nanother person will be available to engage in an act\n\nof prostitution with a third party,\n\ni. determining, dictating or setting the places at which\n\nanother person will be available for solicitation of,\n\nor to engage in, an act of prostitution with a third\n\nparty, or\n\nj. determining, dictating or setting the places at which\n\nanother person will reside for purposes of making such\n\nperson available to engage in an act of prostitution\n\nwith a third party;\n\n2. \"Commercial sex\" means any form of commercial sexual\n\nactivity such as sexually explicit performances, prostitution,\n\nparticipation in the production of pornography, performance in a\n\nstrip club, or exotic dancing or display;\n\n3. \"Debt bondage\" means the status or condition of a debtor\n\narising from a pledge by the debtor of his or her personal services\n\nor of those of a person under his or her control as a security for\n\ndebt if the value of those services as reasonably assessed is not\n\napplied toward the liquidation of the debt or the length and nature\n\nof those services are not respectively limited and defined;\n\n4. \"Human trafficking\" means modern-day slavery that includes,\n\nbut is not limited to, extreme exploitation and the denial of\n\nfreedom or liberty of an individual for purposes of deriving benefit\n\nfrom that individual's commercial sex act or labor;\n\n5. \"Human trafficking for labor\" means:\n\na. recruiting, enticing, harboring, maintaining,\n\ntransporting, providing or obtaining, by any means,\n\nanother person through deception, force, fraud, threat\n\nor coercion or for purposes of engaging the person in\n\nlabor, or\n\nb. benefiting, financially or by receiving anything of\n\nvalue, from participation in a venture that has\n\nengaged in an act of trafficking for labor;\n\n6. \"Human trafficking for commercial sex\" means:\n\na. recruiting, enticing, harboring, maintaining,\n\ntransporting, providing or obtaining, by any means,\n\nanother person through deception, force, fraud, threat\n\nor coercion for purposes of engaging the person in a\n\ncommercial sex act,\n\nb. recruiting, enticing, harboring, maintaining,\n\ntransporting, providing, purchasing or obtaining, by\n\nany means, a minor for purposes of engaging the minor\n\nin a commercial sex act, or\n\nc. benefiting, financially or by receiving anything of\n\nvalue, from participating in a venture that has\n\nengaged in an act of trafficking for commercial sex;\n\n7. \"Legal process\" means the criminal law, the civil law, or\n\nthe regulatory system of the federal government, any state,\n\nterritory, district, commonwealth, or trust territory therein, and\n\nany foreign government or subdivision thereof and includes legal\n\ncivil actions, criminal actions, and regulatory petitions or\n\napplications;\nure that has\n\nengaged in an act of trafficking for commercial sex;\n\n7. \"Legal process\" means the criminal law, the civil law, or\n\nthe regulatory system of the federal government, any state,\n\nterritory, district, commonwealth, or trust territory therein, and\n\nany foreign government or subdivision thereof and includes legal\n\ncivil actions, criminal actions, and regulatory petitions or\n\napplications;\n\n8. \"Minor\" means an individual under eighteen (18) years of\n\nage; and\n\n9. \"Victim\" means a person against whom a violation of any\n\nprovision of this section has been committed.\n\nB. It shall be unlawful to knowingly engage in human\n\ntrafficking.\n\nC. 1. Any person violating the provisions of this section\n\nshall, upon conviction, be guilty of a felony punishable by\n\nimprisonment in the custody of the Department of Corrections for a\n\nterm of not less than five (5) years or for life, or by a fine of\n\nnot more than One Hundred Thousand Dollars ($100,000.00), or by both\n\nsuch fine and imprisonment.\n\n2. Any person violating the provisions of this section where\n\nthe victim of the offense is under eighteen (18) years of age at the\n\ntime of the offense shall, upon conviction, be guilty of a felony\n\npunishable by imprisonment in the custody of the Department of\n\nCorrections for a term of not less than ten (10) years, for life, or\n\nfor life without parole, or by a fine of not more than Two Hundred\n\nFifty Thousand Dollars ($250,000.00), or by both such fine and\n\nimprisonment.\n\n3. The court shall also order the defendant to pay restitution\n\nto the victim as provided in Section 991f of Title 22 of the\n\nOklahoma Statutes. In addition, the court shall require the\n\ndefendant to pay for a psychological evaluation to determine the\n\nextent of counseling necessary for the human trafficking victim and\n\nany necessary psychological counseling deemed necessary to\n\nrehabilitate the victim. Such evaluations and counseling may be\n\nperformed by psychiatrists, psychologists, licensed professional\n\ncounselors, or social workers.\n\n4. If the person is convicted of human trafficking, the person\n\nshall serve eighty-five percent (85%) of the sentence before being\n\neligible for parole consideration or any earned credits. The terms\n\nof imprisonment specified in this subsection shall not be subject to\n\nstatutory provisions for suspension, deferral or probation, or state\n\ncorrectional institution earned credits accruing from and after\n\nNovember 1, 1989, except for the achievement earned credits\n\nauthorized by subsection H of Section 138 of Title 57 of the\n\nOklahoma Statutes. To qualify for such achievement earned credits,\n\nsuch inmates must also be in compliance with the standards for Class\n\nlevel 2 behavior, as defined in subsection D of Section 138 of Title\n\n57 of the Oklahoma Statutes.\n\nD. It is an affirmative defense to prosecution for a criminal,\n\nyouthful offender, or delinquent offense that, during the time of\n\nthe alleged commission of the offense, the defendant or alleged\n\nyouthful offender or delinquent was a victim of human trafficking.\n\nE. The consent of a victim to the activity prohibited by this\n\nsection shall not constitute a defense.\n\nF.
