It shall be unlawful for any person to perform or offer to\n\nperform body piercing or tattooing on a child under eighteen (18)\n\nyears of age. No person under eighteen (18) years of age shall be\n\nallowed to receive a tattoo. No person under eighteen (18) years of\n\nage shall be allowed to receive a body piercing procedure unless the\n\nparent or legal guardian of such child gives written consent for the\n\nprocedure, and the parent or legal guardian of the child is present\n\nduring the procedure. No person shall be allowed to purchase or\n\npossess tattoo equipment or supplies without being licensed either\n\nas an Oklahoma medical micropigmentologist or as an Oklahoma tattoo\n\nartist.\n\nB. Tattooing shall not be performed upon a person impaired by\n\ndrugs or alcohol. A person impaired by drugs or alcohol is\n\nconsidered incapable of consenting to tattooing and incapable of\n\nunderstanding tattooing procedures and aftercare suggestions.\n\nC. It shall be unlawful for any person to perform or offer to\n\nperform scleral tattooing upon a person.\n\nD. As used in this section and Sections 842.2 and 842.3 of this\n\ntitle:\n\n1. \"Body piercing\" means a procedure in which an opening is\n\ncreated in a human body solely for the purpose of inserting jewelry\n\nor other decoration; provided, however, the term does not include\n\near piercing;\n\n2. “Tattooing” means the practice of producing an indelible\n\nmark or figure on the human body by scarring or inserting a pigment\n\nunder the skin using needles, scalpels, or other related equipment;\n\nprovided, that medical micropigmentation, performed pursuant to the\n\nprovisions of the Oklahoma Medical Micropigmentation Regulation Act,\n\nshall not be construed to be tattooing;\n\n3. “Body piercing operator” means any person who owns,\n\ncontrols, operates, conducts, or manages any permanent body piercing\n\nestablishment, whether actually performing the work of body piercing\n\nor not. A mobile unit, including, but not limited to, a mobile\n\nhome, recreational vehicle, or any other nonpermanent facility,\n\nshall not be used as a permanent body piercing establishment;\n\n4. “Tattoo operator” means any person who owns, controls,\n\noperates, conducts, or manages any permanent tattooing establishment\n\nwhether performing the work of tattooing or not, or a temporary\n\nlocation that is a fixed location at which an individual tattoo\n\noperator performs tattooing for a specified period of not more than\n\nseven (7) days in conjunction with a single event or celebration,\n\nwhere the primary function of the event or celebration is tattooing;\n\n5. \"Artist\" means the person who actually performs the body\n\npiercing or tattooing procedure;\n\n6. “Apprentice” means any person who is training under the\n\nsupervision of a licensed tattoo artist. That person cannot\n\nindependently perform the work of tattooing. Apprentice also means\n\nany person who is training under the supervision of a licensed body\n\nartist. That person cannot independently perform the work of body\n\npiercing; and\n\n7. “Scleral tattooing” means the practice of producing an\n\nindelible mark or figure on the human eye by scarring or inserting a\n\npigment on, in, or under the fornix conjunctiva, bulbar conjunctiva,\n\nocular conjunctive, or other ocular surface using needles, scalpels\n\nor other related equipment.\n\nE. Sections 842.1 through 842.3 of this title shall not apply\n\nto any act of a licensed practitioner of the healing arts performed\n\nin the course of practice of the practitioner.\n\nF.
