No person shall maliciously and with the specific intent to\n\nintimidate or harass another person because of that person's race,\n\ncolor, religion, ancestry, national origin or disability:\n\n1. Assault or batter another person;\n\n2. Damage, destroy, vandalize or deface any real or personal\n\nproperty of another person; or\n\n3. Threaten, by word or act, to do any act prohibited by\n\nparagraph 1 or 2 of this subsection if there is reasonable cause to\n\nbelieve that such act will occur.\n\nB. No person shall maliciously and with specific intent to\n\nincite or produce, and which is likely to incite or produce,\n\nimminent violence, which violence would be directed against another\n\nperson because of that person's race, color, religion, ancestry,\n\nnational origin or disability, make or transmit, cause or allow to\n\nbe transmitted, any telephonic, computerized, or electronic message.\n\nC. No person shall maliciously and with specific intent to\n\nincite or produce, and which is likely to incite or produce,\n\nimminent violence, which violence would be directed against another\n\nperson because of that person's race, color, religion, ancestry,\n\nnational origin or disability, broadcast, publish, or distribute,\n\ncause or allow to be broadcast, published or distributed, any\n\nmessage or material.\n\nD. Any person convicted of violating any provision of\n\nsubsections A, B or C of this section shall be guilty of a\n\nmisdemeanor on a first offense and a Class B4 felony offense\n\npunishable by not more than ten (10) years incarceration in the\n\ncustody of the Department of Corrections for a second or subsequent\n\noffense. The fine for a felony violation of this section shall not\n\nexceed Ten Thousand Dollars ($10,000.00). Furthermore, said person\n\nshall be civilly liable for any damages resulting from any violation\n\nof this section.\n\nE. Upon conviction, any person guilty of a misdemeanor in\n\nviolation of this section shall be punishable by the imposition of a\n\nfine not exceeding One Thousand Dollars ($1,000.00), or by\n\nimprisonment in the county jail for a period of not more than one\n\n(1) year, or by both such fine and imprisonment.\n\nF. The Oklahoma State Bureau of Investigation shall develop a\n\nstandard system for state and local law enforcement agencies to\n\nreport incidents of crime which are apparently directed against\n\nmembers of racial, ethnic, religious groups or other groups\n\nspecified by this section. The Oklahoma State Bureau of\n\nInvestigation shall promulgate rules, regulations and procedures\n\nnecessary to develop, implement and maintain a standard system for\n\nthe collection and reporting of hate crime data. All state, county,\n\ncity and town law enforcement agencies shall submit a monthly report\n\nto the Oklahoma State Bureau of Investigation on forms prescribed by\n\nthe Bureau. The report shall contain the number and nature of the\n\noffenses committed within their respective jurisdictions, the\n\ndisposition of such matters and any other information the Bureau may\n\nrequire, respecting information relating to the cause and prevention\n\nof crime, recidivism, the rehabilitation of criminals and the proper\n\nadministration of criminal justice.\n\nG. No person, partnership, company or corporation that installs\n\ntelephonic, computerized, or electronic message equipment shall be\n\nrequired to monitor the use of such equipment for possible\n\nviolations of this section, nor shall such person, partnership,\n\ncompany or corporation be held criminally or civilly liable for the\n\nuse by another person of the equipment in violation of this section,\n\nunless the person, partnership, company or corporation that\n\ninstalled the equipment had prior actual knowledge that the\n\nequipment was to be used in violation of this section.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"299d0ea85d3e82827b15b4c301df640fded98abe0b2538639820829adc3c8d5b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-849","next":"us-ok/okla.-stat.-tit.-21-21-851"},"notice":"GroundRules: Original legal text.
