A \"bet\" is a bargain in which the parties agree that,\n\ndependent upon chance, or in which one of the parties to the\n\ntransaction has valid reason to believe that it is dependent upon\n\nchance, one stands to win or lose something of value specified in\n\nthe agreement. A bet does not include:\n\na. bona fide business transactions which are valid under\n\nthe law of contracts including, but not limited to,\n\ncontracts for the purchase or sale at a future date of\n\nsecurities or other commodities and agreements to\n\ncompensation for loss caused by the happening of the\n\nchance including, but not limited to, contracts of\n\nindemnity or guaranty and life or health and accident\n\ninsurance; or\n\nb. any charity game conducted pursuant to the provisions\n\nof the Oklahoma Charity Games Act; or\n\nc. offers of purses, prizes or premiums to the actual\n\nparticipants in public and semipublic events, as\n\nfollows, to wit: Rodeos, animal shows, hunting,\n\nfishing or shooting competitions, expositions, fairs,\n\nathletic events, tournaments and other shows and\n\ncontests where the participants qualify for a monetary\n\nprize or other recognition. This subparagraph further\n\nexcepts an entry fee from the definition of \"a bet\" as\n\napplied to enumerated public and semipublic events.\n\n2. \"Consideration\" as used in this section means anything which\n\nis a commercial or financial advantage to the promoter or a\n\ndisadvantage to any participant. Mere registration without purchase\n\nof goods or services; personal attendance at places or events,\n\nwithout payment of an admission price or fee; listening to or\n\nwatching radio and television programs; answering the telephone or\n\nmaking a telephone call and acts of like nature are not\n\nconsideration. As used in this paragraph, the term \"consideration\"\n\nshall not include sums of money paid by or for participants in any\n\nbingo game or a game of chance with comparable characteristics as\n\ndefined by subparagraph b of paragraph 1 of this section and it\n\nshall be conclusively presumed that such sums paid by or for said\n\nparticipants were intended by said participants to be for the\n\nbenefit of the organizations described in subparagraph b of\n\nparagraph 1 of this section for the use of such organizations in\n\nfurthering the purposes of such organizations;\n\n3. A \"gambling device\" is a contrivance designed primarily for\n\ngambling purposes which for a consideration affords the player an\n\nopportunity to obtain something of value, the award of which is\n\ndetermined by chance, or any token, chip, paper, receipt or other\n\ndocument which evidences, purports to evidence or is designed to\n\nevidence participation in a lottery or the making of a bet. The\n\nfact that the prize is not automatically paid by the device does not\n\naffect its character as a gambling device; and\n\n4. A \"gambling place\" is any place, room, building, vehicle,\n\ntent or location which is used for any of the following: making and\n\nsettling bets; receiving, holding, recording or forwarding bets or\n\noffers to bet; conducting lotteries; or playing gambling devices.\n\nEvidence that the place has a general reputation as a gambling place\n\nor that, at or about the time in question, it was frequently visited\n\nby persons known to be commercial gamblers or known as frequenters\n\nof gambling places is admissible on the issue of whether it is a\n\ngambling place.","path":["OK Code","Title 21"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os21.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"65cb80954e5d6b16ac7805470663cb5d66fbdb4464616855ab90f0451f76daf2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-21-21-98","next":"us-ok/okla.-stat.-tit.-21-21-982"},"notice":"GroundRules: Original legal text.
