Stat. tit. 22, § 22-1053","heading":"Appeals taken by state or municipality – Allowable cases","body":"Appeals to the Court of Criminal Appeals may be taken by the\n\nstate or a municipality in the following cases only:\n\n1. Upon judgment for the defendant on quashing or setting aside\n\nan indictment or information;\n\n2. Upon an order of the court arresting the judgment;\n\n3. Upon a question reserved by the state or a municipality;\n\n4. Upon judgment for the defendant on a motion to quash for\n\ninsufficient evidence in a felony matter;\n\n5. Upon a pretrial order, decision, or judgment suppressing or\n\nexcluding evidence where appellate review of the issue would be in\n\nthe best interests of justice;\n\n6. Upon a pretrial order, decision or judgment suppressing or\n\nexcluding evidence in cases alleging violation of any provisions of\n\nSection 13.1 of Title 21 of the Oklahoma Statutes; and\n\n7. Upon an order, decision or judgment finding that a defendant\n\nis immune from or not subject to criminal prosecution.\n\nPriority shall be given to appeals taken pursuant to paragraph\n\n5, 6, or 7 of this section, and an order staying proceedings shall\n\nbe entered pending the outcome of the appeal.\n\nR.L. 1910, § 5990.
