Stat. tit. 22, § 22-1058","heading":"Conditions of bond - Surrender by sureties - Stay of","body":"execution - Confinement of defendant when crime not bailable.\n\nIf an appeal is taken and the appeal bond given as provided in\n\nthe preceding section, said bond shall be conditioned that the\n\ndefendant will appear, submit to and perform any judgment rendered\n\nby the Criminal Court of Appeals or the court in which the original\n\njudgment was rendered in the further progress of the cause, and will\n\nnot depart without leave of the court. After the determination of\n\nthe appeal in the Criminal Court of Appeals, or if the appeal is not\n\nperfected as provided by law, the defendant may be surrendered by\n\nthe sureties to the proper authorities for the execution of the\n\nsentence. If the defendant be adjudged to be incarcerated in any\n\npenal institution and/or to pay a fine, said sureties shall be\n\nrelieved of liability for such fine and costs upon surrender of the\n\ndefendant to the proper authorities for incarceration pursuant to\n\nthe judgment and prior to forfeiture of the bond. If no bond be\n\ngiven the appeal shall not stay execution of the judgment, except in\n\ncapital cases or where otherwise specifically provided by law. If\n\npending the appeal the bond be given, a further execution of the\n\njudgment shall be stayed and the defendant released pending the\n\ndetermination of the appeal.
