Stat. tit. 22, § 22-1066","heading":"Power of appellate court - Return by clerk of lower court","body":"when new trial granted.\n\nThe appellate court may reverse, affirm or modify the judgment\n\nor sentence appealed from, and may, if necessary or proper, order a\n\nnew trial or resentencing. In either case, the cause must be\n\nremanded to the court below, with proper instructions, and the\n\nopinion of the court, within the time, and in the manner, to be\n\nprescribed by rule of the court.\n\nIf the case is reversed for a new trial, the clerk of the court\n\nfrom which such cause was appealed is required to make return\n\nshowing that said case was specifically called to the attention of\n\nthe trial court at the time of the setting of the docket following\n\nreceipt of mandate, and showing the court's action in placing said\n\ncause on the docket for trial, said return to be made immediately\n\nafter the trial and entry of judgment, or earlier disposal.
