Stat. tit. 22, § 22-1072","heading":"Record and enforcement of mandate or order in lower court","body":"- Return by clerk of lower court to clerk of Criminal Court of\n\nAppeals.\n\nIt is hereby made the duty of the court clerk in all counties,\n\nupon receipt from the Clerk of the Criminal Court of Appeals of any\n\nmandate or order of the Criminal Court of Appeals, to immediately\n\nand without any order from the court, or judge thereof, to spread\n\nsaid mandate or order of record in the proper court, and to issue\n\nand place in the hands of the proper officer appropriate process for\n\ncarrying out such mandate or order.\n\nThat it shall be the duty of any such court clerk to immediately\n\nupon return being made by the officer to whom process is delivered,\n\nto thereafter make return to the Clerk of the Criminal Court of\n\nAppeals, showing the date that mandate was received, date filed and\n\nrecorded, the date process was issued to the officer, and the date\n\nthe process was served and whether the convicted person was\n\nincarcerated. If incarceration of the prisoner is delayed by reason\n\nof flight, or for any other cause for a period of more than fifteen\n\n(15) days after receipt of mandate, the return, under any such\n\ncircumstance causing delay, must be immediately made to the Clerk of\n\nthe Criminal Court of Appeals; and upon later apprehension of\n\nprisoner and incarceration, a further return must be made to the\n\nClerk of the Criminal Court of Appeals, reporting the facts, within\n\nten (10) days after such incarceration.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7c10bdae436a59f04f71070a25c8d2b0ec5399868ebe053e2f4819c24e996eed","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1071.1","next":"us-ok/okla.-stat.-tit.-22-22-1076"},"notice":"GroundRules: Original legal text.
