Stat. tit. 22, § 22-1080","heading":"Post-Conviction Procedure Act - Right to challenge","body":"conviction or sentence.\n\nAny person who has been convicted of, or sentenced for, a crime\n\nand who claims:\n\n1. That the conviction or the sentence was in violation of the\n\nConstitution of the United States or the Constitution or laws of\n\nthis state;\n\n2. That the court was without jurisdiction to impose sentence;\n\n3. That the sentence exceeds the maximum authorized by law;\n\n4. That there exists evidence of material facts, not previously\n\npresented and heard, that requires vacation of the conviction or\n\nsentence in the interest of justice;\n\n5. That the sentence has expired, the suspended sentence,\n\nprobation, parole, or conditional release unlawfully revoked, or he\n\nor she is otherwise unlawfully held in custody or other restraint;\n\nor\n\n6. That the conviction or sentence is otherwise subject to\n\ncollateral attack upon any ground of alleged error heretofore\n\navailable under any common law, statutory or other writ, motion,\n\npetition, proceeding or remedy,\n\nmay institute a proceeding under the Post-Conviction Procedure Act\n\nin the court in which the judgment and sentence on conviction was\n\nimposed to secure the appropriate relief.
