Stat. tit. 22, § 22-1084","heading":"Evidentiary hearing - Findings of fact and conclusions of","body":"law.\n\nIf the application cannot be disposed of on the pleadings and\n\nrecord, or there exists a material issue of fact, the court shall\n\nconduct an evidentiary hearing at which time a record shall be made\n\nand preserved. The court may receive proof by affidavits,\n\ndepositions, oral testimony, or other evidence and may order the\n\napplicant brought before it for the hearing. A judge should not\n\npreside at such a hearing if his testimony is material. The court\n\nshall make specific findings of fact, and state expressly its\n\nconclusions of law, relating to each issue presented.
