By presenting to the court, whether by signing, filing,\n\nsubmitting, or later advocating, a pleading, written motion or other\n\npapers regarding an application for post-conviction relief an\n\nattorney or unrepresented party is certifying that to the best of\n\nthe person's knowledge, information, and belief, formed after an\n\ninquiry reasonable under the circumstances:\n\n1. It is not being presented for any improper purpose, such as\n\nto harass or to cause unnecessary delay or needless increase in the\n\ncost of litigation;\n\n2. The claims and other legal contentions therein are warranted\n\nby existing law or by a nonfrivolous argument for the extension,\n\nmodification, or reversal of existing law or the establishment of\n\nnew law; and\n\n3. The allegations and other factual contentions have\n\nevidentiary support or, if specifically so identified, are likely to\n\nhave evidentiary support after a reasonable opportunity for further\n\ninvestigation or discovery.\n\nB.
