If in open court at the time the adverse ruling or order is\n\nmade by the magistrate, the state shall give notice of its intention\n\nto appeal the decision. The magistrate shall then enter the notice\n\nin the proper court docket, continue the preliminary hearing and\n\nretain the accused on the present bond or if the person is in\n\ncustody, return the accused to custody. The state shall file with\n\nthe court clerk a written application to appeal from the adverse\n\nruling or order of the magistrate within five (5) days from the date\n\nof the adverse ruling or order.\n\nB. If not in open court at the time the adverse ruling or order\n\nis made by the magistrate, within five (5) days from the date of the\n\nadverse ruling or order, the state shall file with the court clerk a\n\nwritten application to appeal from the adverse ruling or order of\n\nthe magistrate.\n\nC. A copy of the application to appeal shall immediately be\n\npresented by the state to the Presiding Judge of the Judicial\n\nAdministrative District. The Presiding Judge shall assign the\n\napplication to another district judge or associate district judge\n\nwithin the same judicial administrative district, and shall order\n\nthe assigned judge to set said matter for hearing and decision\n\nwithin twenty (20) days from the filing of the written application\n\nto appeal and shall provide at least three (3) days’ notice to all\n\nparties of the time and place of the hearing. In the absence of the\n\nPresiding Judge of the Judicial Administrative District, the Acting\n\nPresiding Judge shall perform the duties of the Presiding Judge as\n\nset forth above.
