Stat. tit. 22, § 22-1108","heading":"Forfeiture of bail","body":"If the defendant neglects to appear according to the terms or\n\nconditions of the recognizance, bond or undertaking, either for\n\nhearing, arraignment, trial or judgment, or upon any other occasion\n\nwhen his presence in court or before the magistrate may be lawfully\n\nrequired, or to surrender himself in execution of the judgment, the\n\ncourt must direct the fact to be entered upon its minutes, and the\n\nrecognizance, bond or undertaking of bail, or the money deposited\n\ninstead of bail, as the case may be, is and shall be thereupon\n\ndeclared forfeited and forfeiture proceedings shall then proceed as\n\nprescribed in Section 1332 of Title 59 of the Oklahoma Statutes. If\n\nmoney deposited instead of bail be so forfeited, the clerk of the\n\ncourt or other officer with whom it is deposited, must, immediately\n\nafter the final adjournment of the court, pay over the money\n\ndeposited to the county treasurer.\n\nProvided however, if a person charged with a traffic offense\n\nneglects to appear for arraignment after signing a written promise\n\nto appear as provided for by the State and Municipal Traffic Bail\n\nBond Procedure Act, Section 1115 et seq. of this title and no other\n\nform of bail has been substituted therefor, then said recognizance\n\nshall not be forfeited as provided in this section and the court\n\nshall proceed in accordance with the provisions of Section 1115 et\n\nseq. of this title.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"25bd769d37cfcef1091795cef24ab0045f1f9a05341e7070e1d32b06538eb17c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1107","next":"us-ok/okla.-stat.-tit.-22-22-1108.1"},"notice":"GroundRules: Original legal text.
