Following receipt of notification and a request for\n\ndriving privilege suspension from a municipal or district court\n\nclerk as provided for in Section 1115.1 of this title or Section 1\n\nof this act, Service Oklahoma shall:\n\na. suspend the privilege of the person to operate a motor\n\nvehicle in this state; or\n\nb. request suspension of the driving privilege of the\n\nperson in the state which issued the license as\n\nprovided by the Nonresident Violator Compact.\n\nA person whose license is subject to suspension pursuant to this\n\nsection may avoid the effective date of the suspension or, if\n\nsuspended, shall be eligible for reinstatement, if otherwise\n\neligible, upon meeting the requirements of subsection C of this\n\nsection.\n\n2. Service Oklahoma may decline to initiate such suspension\n\naction if the request is discovered to be improper or questionable.\n\n3. Service Oklahoma shall not be required to issue more than\n\none suspension of the driving privilege of a person in the event\n\nmultiple requests for suspensions are received from a court clerk\n\nbased upon the failure of the person to appear at a particular time\n\nand date on multiple charges.\n\nB. Following receipt of a request from another jurisdiction for\n\nthe suspension of the driving privilege of an Oklahoma resident as\n\nprovided by the Nonresident Violator Compact, Service Oklahoma, if\n\nthe request appears to be valid, shall initiate suspension of the\n\nprivilege of the person to operate a motor vehicle in this state.\n\nIf suspended, such suspension shall remain in effect until the\n\nperson meets the requirements of subsection C of this section.\n\nC. 1. A person whose license is subject to suspension in this\n\nstate pursuant to the provisions of this section may avoid the\n\neffective date of suspension, or if suspended in this state, shall\n\nbe eligible for reinstatement, if otherwise eligible, upon:\n\na. making application therefore to Service Oklahoma, and\n\nb. showing proof from the court or court clerk that the\n\nperson has entered an appearance in the case which was\n\nthe basis for the suspension action and was released\n\nby the court as provided for by the Nonresident\n\nViolator Compact or consistent provisions, and\n\nc. submitting with the application the fees, as provided\n\nfor in Section 6-212 of Title 47 of the Oklahoma\n\nStatutes. The fees shall be remitted to the State\n\nTreasurer to be credited to the General Revenue Fund\n\nof the State Treasury;\n\n2. Upon reinstatement, Service Oklahoma may remove any record\n\nof the suspension and reinstatement as provided for in this section\n\nfrom the file of the individual licensee and maintain an internal\n\nrecord of the suspension and reinstatement for fiscal and other\n\npurposes.\n\nD. Any person whose driving privilege is suspended or subject\n\nto suspension in this state pursuant to the provisions of this\n\nsection, at any time, may informally present specific reasons or\n\ndocumentation to Service Oklahoma to show that such suspension may\n\nbe unwarranted. Service Oklahoma may stay the suspension or\n\nsuspension action pending receipt of further information or\n\ndocumentation from the person or from the jurisdiction requesting\n\nsuch suspension, or pending review of the record, or other inquiry.\n\nIf Service Oklahoma determines the suspension is unwarranted, the\n\nsuspension action shall be withdrawn or vacated without the\n\nrequirement of a processing fee and a reinstatement fee and Service\n\nOklahoma shall accordingly notify the jurisdiction which requested\n\nthe suspension. If, however, the request for suspension appears\n\nvalid, Service Oklahoma shall proceed with suspension of the driving\n\nprivilege of the person and the person shall have the right to\n\nappeal as provided for by Section 6-211 of Title 47 of the Oklahoma\n\nStatutes. Provided, however, the court shall not consider\n\nmodification, but shall either sustain or vacate the order of\nrequested\n\nthe suspension. If, however, the request for suspension appears\n\nvalid, Service Oklahoma shall proceed with suspension of the driving\n\nprivilege of the person and the person shall have the right to\n\nappeal as provided for by Section 6-211 of Title 47 of the Oklahoma\n\nStatutes.
