Referral of a bogus check complaint to the Bogus Check\n\nRestitution Program shall be at the discretion of the district\n\nattorney. This act shall not limit the power of the district\n\nattorney to prosecute bogus check complaints.\n\nB. Upon receipt of a bogus check complaint, the district\n\nattorney shall determine if the complaint is one which is\n\nappropriate to be referred to the Bogus Check Restitution Program.\n\nC. In determining whether to refer a case to the Bogus Check\n\nRestitution Program, the district attorney shall consider the\n\nfollowing guidelines:\n\n1. The amount of the bogus check;\n\n2. If there is a prior criminal record of the defendant;\n\n3. The number of bogus check complaints against the defendant\n\npreviously received by the district attorney;\n\n4. Whether or not there are other bogus check complaints\n\ncurrently pending against the defendant; and\n\n5.
