Stat. tit. 22, § 22-1164","heading":"Order of trial of sanity","body":"The trial of the question of insanity must proceed in the\n\nfollowing order:\n\n1. The counsel for the defendant must open the case and offer\n\nevidence in support of the allegation of insanity.\n\n2. The counsel for the state may then open their case and offer\n\nevidence in support thereof.\n\n3. The parties may then respectively offer rebutting testimony\n\nonly, unless the court, for good reason, in furtherance of justice,\n\npermit them to offer evidence upon their original case.\n\n4. When the evidence is concluded, unless the case be submitted\n\nto the jury on either side or on both sides, without argument, the\n\ncounsel for the state must commence, and the defendant or his\n\ncounsel may conclude the argument to the jury.\n\n5. If the indictment be for an offense punishable with death\n\ntwo counsels on each side may argue the causes to the jury, in which\n\ncase they must do so alternately. If it be for any other offense,\n\nthe court may, in its discretion, restrict the argument to one\n\ncounsel on each side.\n\n6.
