A search warrant may be issued and property seized upon any\n\nof the following grounds:\n\nFirst: When the property was stolen or embezzled, in which case\n\nit may be taken on the warrant, from any house or other place in\n\nwhich it is concealed, or from the possession of the person by whom\n\nit was stolen or embezzled, or of any other person in whose\n\npossession it may be.\n\nSecond: When it was used as the means of committing a felony,\n\nin which case it may be taken on the warrant from any house or other\n\nplace in which it is concealed, or from the possession of the person\n\nby whom it was used in the commission of the offense, or of any\n\nother person in whose possession it may be.\n\nThird: When it is in the possession of any person, with the\n\nintent to use it as the means of committing a public offense, or in\n\nthe possession of another to whom the person may have delivered it\n\nfor the purpose of concealing it or preventing its being discovered,\n\nin which case it may be taken on the warrant from such person, or\n\nfrom a house or other place occupied by the person, or under the\n\nperson’s control, or from the possession of the person to whom the\n\nperson may have so delivered it.\n\nFourth: When the property constitutes evidence that an offense\n\nwas committed or that a particular person participated in the\n\ncommission of an offense.\n\nFifth: When there is probable cause to believe that, at a\n\nfuture time, the property or items sought which are intended to be\n\nused to commit a public offense, will be located at a particular\n\nplace. Under such circumstances, the magistrate shall insert a\n\ndirection in the search warrant making execution of the warrant\n\ncontingent upon the happening of an event which evidences probable\n\ncause that the item to be seized is in the place to be searched.\n\nSixth: As authorized by any provision of the Security of\n\nCommunications Act.\n\nB.
