The System shall perfect all direct appeals and capital\n\npost-conviction proceedings for all cases to which the System is\n\nappointed by Oklahoma district courts at the time the appeal is\n\ninitiated, except as otherwise provided in this section and Section\n\n1358 of this title. In counties subject to the provisions of\n\nSection 138.1a of Title 19 of the Oklahoma Statutes, the System\n\nshall perfect direct appeals for indigent defendants who were not\n\nrepresented at trial by the county indigent defender. The System\n\nshall not be appointed to perfect direct appeals for indigents\n\nrepresented at trial by the county indigent defender, unless a\n\nconflict of interest on appeal exists between defendants, in which\n\ncase the System may be appointed to represent not more than one\n\ndefendant.\n\nB. Judges of the district courts shall appoint the System, at\n\nthe time the appeal is initiated, in cases in which the defendant is\n\nsubject to incarceration or the death penalty, and to perfect all\n\nindigent criminal appeals which are felony or misdemeanor appeals,\n\nappeals by petition for writ of certiorari, juvenile criminal\n\nappeals and youthful offender appeals pursuant to the Oklahoma\n\nJuvenile Code, appeals from revocation of a suspended sentence and\n\nappeals from acceleration of deferred judgments.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"858219868f9a7086df0351b8f9e5fc6d284d6907cd72468823c245c330e85061","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1355a","next":"us-ok/okla.-stat.-tit.-22-22-1358"},"notice":"GroundRules: Original legal text.
