Stat. tit. 22, § 22-1358","heading":"Reassignment of cases","body":"If the Executive Director determines that a conflict exists\n\nafter evaluating a case assigned pursuant to Section 1356 of this\n\ntitle, the Executive Director shall reassign the case in the same\n\nmanner as is provided for conflicts at the trial level in Section\n\n1355.7 of this title, unless the case is from a county subject to\n\nthe provisions of Section 138.1a of Title 19 of the Oklahoma\n\nStatutes and the indigent defendant was not represented at trial by\n\nthe county indigent defender. If the Executive Director determines\n\na conflict exists in a case from a county subject to the provisions\n\nof Section 138.1a of Title 19 of the Oklahoma Statutes and the\n\nindigent defendant was not represented at trial by the county\n\nindigent defender, the county indigent defender shall be appointed\n\nto represent the indigent defendant. The appointment of the county\n\nindigent defender shall be made by the district court at the time\n\nthe appeal is initiated or by the Court of Criminal Appeals after\n\nthe appeal is initiated. If the district court, at the time the\n\nappeal is initiated, or the Court of Criminal Appeals, after the\n\nappeal has been initiated, determines that the county indigent\n\ndefender also has a conflict of interest in the case, the district\n\ncourt, initially or on remand from the Court of Criminal Appeals,\n\nshall appoint counsel in the same manner as is provided for\n\nconflicts at the trial level in Section 138.7 of Title 19 of the\n\nOklahoma Statutes, by reassigning the case to another county\n\nindigent defender, an attorney who represents indigents pursuant to\n\ncontract, or a private attorney has agreed to accept such\n\nappointments.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c1b80a324fb1bd194ce6a83439a368916429df342323bcd68490b6ac4a6f4170","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1356","next":"us-ok/okla.-stat.-tit.-22-22-1359"},"notice":"GroundRules: Original legal text.
