A criminal justice agency having possession or custody of\n\nbiological evidence from a violent felony offense, as defined by\n\nsubsection F of Section 982 of Title 22 of the Oklahoma Statutes,\n\nshall retain and preserve that biological evidence for such period\n\nof time as any individual convicted of that crime remains\n\nincarcerated.\n\nB. As used in this section:\n\n1. \"Biological evidence\" means physical evidentiary material\n\noriginating from the human body from which a nuclear DNA profile or\n\nmitochondrial DNA sequence can be obtained or representative or\n\nderivative samples of such physical evidentiary material collected\n\nby a forensic DNA laboratory; and\n\n2. \"DNA\" means deoxyribonucleic acid.\n\nC. The criminal justice agency in possession or custody of\n\nbiological evidence may destroy or otherwise dispose of the\n\nbiological evidence before the expiration of the period of time\n\ndescribed in subsection A of this section only if:\n\n1. The agency notifies any person who remains incarcerated in\n\nconnection with the case, the Oklahoma Indigent Defense System DNA\n\nForensic Testing Program if still applicable, and any counsel of\n\nrecord or public defender organization for the judicial district in\n\nwhich the judgment of conviction for such person was entered, of:\n\na. the intention of the agency to destroy the evidence,\n\nand\n\nb. the provisions of the DNA Forensic Testing Act, if\n\nstill applicable;\n\n2. No person submits a written objection to the destruction of\n\nthe biological evidence to the agency within ninety (90) days of\n\nreceiving notice pursuant to paragraph 1 of this subsection; and\n\n3.
