If the results of the forensic DNA testing conducted under\n\nthe provisions of the Postconviction DNA Act are favorable to the\n\npetitioner, the court shall schedule a hearing to determine the\n\nappropriate relief to be granted. Based on the results of the\n\ntesting and any other evidence presented at the hearing, the court\n\nshall thereafter enter any order that serves the interests of\n\njustice including, but not limited to, any of the following:\n\n1. An order setting aside or vacating the judgment of\n\nconviction, judgment of not guilty by reason of mental disease or\n\ndefect or adjudication of delinquency;\n\n2. An order granting the petitioner a new trial or fact-finding\n\nhearing;\n\n3. An order granting the petitioner a new commitment hearing or\n\ndispositional hearing;\n\n4. An order discharging the petitioner from custody;\n\n5. An order specifying the disposition of any evidence that\n\nremains after the completion of the testing;\n\n6. An order granting the petitioner additional discovery on\n\nmatters related to the DNA test results on the conviction or\n\nsentence under scrutiny including, but not limited to, documents\n\npertaining to the original criminal investigation or the identities\n\nof other suspects; or\n\n7. An order directing the state to place any unidentified DNA\n\nprofile or profiles obtained from postconviction DNA testing into\n\nOklahoma or federal databases as allowed within applicable state and\n\nfederal laws.\n\nB. If the court issues an order setting aside or vacating the\n\njudgment of conviction and dismisses the case with prejudice, a copy\n\nof the order indicating the individual has been exonerated through\n\nDNA testing shall be submitted to the Oklahoma State Bureau of\n\nInvestigation in accordance with the requirements of Section 150.12\n\nof Title 74 of the Oklahoma Statutes.\n\nC. If the results of the tests are not favorable to the\n\npetitioner, the court shall:\n\n1. Dismiss the motion; and\n\n2. Make such further orders as the court deems appropriate,\n\nincluding an order that:\n\na. requires the DNA test results be provided to the\n\nPardon and Parole Board or Department of Corrections,\n\nor\n\nb. requests the DNA profile of the petitioner be added to\n\nthe convicted offender index database of the OSBI\n\nCombined DNA Index System (CODIS) Database as provided\n\nby law.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"076bce1a35900812e33b7165906ca258392634c721d9be1d973c032d6336da24","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1373.4","next":"us-ok/okla.-stat.-tit.-22-22-1373.6"},"notice":"GroundRules: Original legal text.
