Any person convicted of violating any provision of Section\n\n1403 of this title shall be guilty of a Class B1 felony offense and\n\nshall be punished by a term of imprisonment in the custody of the\n\nDepartment of Corrections of not less than ten (10) years and shall\n\nnot be eligible for a deferred sentence, probation, suspension, work\n\nfurlough, or release from confinement on any other basis until the\n\nperson has served one-half (1/2) of the sentence. A violation of\n\neach of the provisions of Section 1403 of this title shall be a\n\nseparate offense.\n\nB. In lieu of the fine authorized by the Oklahoma Racketeer-\n\nInfluenced and Corrupt Organizations Act, any person convicted of\n\nviolating any provision of Section 1403 of this title, through which\n\nthe person derived pecuniary value, or by which the person caused\n\npersonal injury, or property damage or other loss, may be sentenced\n\nto pay a fine that does not exceed three times the gross value\n\ngained or three times the gross loss caused, whichever is greater,\n\nplus court costs and the costs of investigation and prosecution\n\nreasonably incurred, less the value of any property ordered\n\nforfeited pursuant to the provisions of subsection A of Section 1405\n\nof this title. The district court shall hold a separate hearing to\n\ndetermine the amount of the fine authorized by the provisions of\n\nthis subsection.\n\nC.
