Any person convicted of violating any of the provisions of\n\nSection 1403 of the Oklahoma Racketeer-Influenced and Corrupt\n\nOrganizations Act shall criminally forfeit to the state, according\n\nto the procedures established in subsection B of this section, any\n\nreal or personal property used in the course of, intended for use in\n\nthe course of, derived from, or realized through conduct in\n\nviolation of Section 1403 of the Oklahoma Racketeer-Influenced and\n\nCorrupt Organizations Act, including any property constituting an\n\ninterest in or means of control or influence over the enterprise\n\ninvolved in the conduct in violation of Section 1403 of the Oklahoma\n\nRacketeer-Influenced and Corrupt Organizations Act, including:\n\n1. Any compensation, right, or benefit derived from a position,\n\noffice, appointment, tenure, commission, or employment contract that\n\naccrued to the person during the course of conduct in violation of\n\nSection 1403 of the Oklahoma Racketeer-Influenced and Corrupt\n\nOrganizations Act;\n\n2. Any interest in, security of, claim against, or property or\n\ncontractual right affording the person a source of influence or\n\ncontrol over the affairs of an enterprise that the person exercised\n\nin violation of Section 1403 of the Oklahoma Racketeer-Influenced\n\nand Corrupt Organizations Act; or\n\n3. Any amount payable or paid pursuant to any contract for\n\ngoods or services that was awarded or performed in violation of\n\nSection 1403 of the Oklahoma Racketeer-Influenced and Corrupt\n\nOrganizations Act.\n\nB. The criminal forfeiture procedures are as follows:\n\n1. A judgment of criminal forfeiture shall not be entered\n\nunless a special verdict containing a finding of property subject to\n\nforfeiture, specifying the extent of such property and describing\n\nwith specificity such property and the circumstances by which the\n\nproperty is subject to forfeiture is returned; and\n\n2. If any property included in a special verdict of criminal\n\nforfeiture:\n\na. cannot be located,\n\nb. has been sold to a bona fide purchaser for value,\n\nc. has been placed beyond the jurisdiction of the court,\n\nd. has been substantially diminished in value by the\n\nconduct of the defendant,\n\ne. has been commingled with other property that cannot be\n\ndivided without difficulty or undue injury to innocent\n\nparties,\n\nf. is otherwise unreachable without undue injury to\n\ninnocent parties, or\n\ng. is subject to a valid security interest, to the extent\n\nof the security interest, held by a bank, savings and\n\nloan association, credit union or supervised lender\n\nlicensed by the Oklahoma Administrator of Consumer\n\nCredit, acquired prior to the lien notice provided by\n\nSection 1412 of this title,\n\nthe district court shall order forfeiture of any other property of\n\nthe defendant up to the value of the property that is unreachable.","path":["OK Code","Title 22"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os22.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"91bb2988282671b3b1f65f749792d86d1efe6682bef63bdc8a8aee2d4bd51a4b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-22-22-1404","next":"us-ok/okla.-stat.-tit.-22-22-1406"},"notice":"GroundRules: Original legal text.
