Stat. tit. 22, § 22-171.3","heading":"Custody of persons subject to immigration detainer","body":"request.\n\nA. A law enforcement agency that has custody of a person who is\n\nsubject to an immigration detainer request issued by the United\n\nStates Immigration and Customs Enforcement shall:\n\n1. Comply with, honor and fulfill any request made in the\n\nimmigration detainer request provided by the United States\n\nImmigration and Customs Enforcement; and\n\n2. Inform the person identified in the immigration detainer\n\nrequest that he or she is being held pursuant to an immigration\n\ndetainer request issued by the United States Immigration and Customs\n\nEnforcement.\n\nB. A law enforcement agency shall not be required to perform a\n\nduty imposed by subsection A of this section with respect to a\n\nperson who has provided proof that the person is a citizen of the\n\nUnited States. Such proof may include:\n\n1. An Oklahoma driver license or identification card issued by\n\nService Oklahoma on or after November 1, 2007; or\n\n2. State- or federal government-issued identification.\n\nC. As used in this section:\n\n1. “Immigration detainer request” means a federal government\n\nrequest to a local entity to maintain temporary custody of an alien,\n\nincluding a United States Department of Homeland Security Form I-247\n\ndocument or a similar successor form; and\n\n2. “Law enforcement agency” means any state, county or\n\nmunicipal agency or department which maintains custody of persons\n\naccused of, charged with or convicted of any criminal offense.
