For purposes of protecting persons who are the victims of\n\nidentity theft, there is hereby created the “Oklahoma Identity Theft\n\nPassport Program”. The Oklahoma State Bureau of Investigation\n\n(OSBI) shall administer the Oklahoma Identity Theft Passport\n\nProgram, prescribe procedures and policies for issuing the identity\n\ntheft passport consistent with this act, and provide information to\n\nlaw enforcement agencies explaining the program.\n\nB. A person shall be eligible for an Oklahoma identity theft\n\npassport if:\n\n1. The person has obtained:\n\na. an order for expungement and sealing of records\n\npursuant to Sections 18 and 19 of Title 22 of the\n\nOklahoma Statutes on grounds that the person has been\n\ncharged or arrested or is the subject of an arrest\n\nwarrant for a crime that was committed by another\n\nperson who has appropriated or used the person’s name\n\nor other identification without the person’s consent\n\nor authorization, or\n\nb. an order for expungement and sealing of records\n\npursuant to Section 2 of this act from a court that\n\ndismissed a charge against the person on such grounds;\n\nor\n\n2. The person has filed an identity theft report with a\n\nfederal, state, or local law enforcement agency and has submitted a\n\ncopy of the identity theft report and an identity theft affidavit\n\nwith supporting documentation to one or more consumer reporting\n\nagencies. For purposes of this act, “identity theft report”,\n\n“identity theft affidavit”, and “consumer reporting agency” shall be\n\ndefined as provided in The Fair Credit Report Act, 15 United States\n\nCode, Section 1681 et seq.\n\nC. To apply for an identity theft passport the person shall\n\nsubmit to the OSBI a certified copy of a court order for expungement\n\nand sealing of records or copies of an identity theft report and\n\nidentity theft affidavit that have been filed and submitted to a\n\nconsumer reporting agency. The OSBI may prescribe other application\n\nrequirements as deemed necessary.\n\nD. The OSBI shall issue the identity theft passport unless the\n\nOSBI finds reasonable cause not to issue the identity theft\n\npassport. The identity theft passport shall state whether the\n\nidentity theft passport is issued on the basis of an order for\n\nexpungement or an identity theft report and affidavit having been\n\nsubmitted to the OSBI.\n\nE. Upon issuance of an identity theft passport, the OSBI shall\n\nnotify the Department of Public Safety. The identity theft passport\n\nshall be attached to any records maintained by the OSBI or the\n\nDepartment of Public Safety, including criminal history records for\n\npurposes of criminal background checks and law enforcement\n\ntelecommunications checks. The record of an identity theft passport\n\nshall be sealed except to law enforcement authorities.\n\nF. The OSBI shall maintain records of identity theft passport\n\nrequests and issuances and may provide such information to law\n\nenforcement agencies upon request of an agency or officer. Such\n\nrecords in the possession of the OSBI or other law enforcement\n\nagencies and officers shall not be public records and shall not be\n\nsubject to the Oklahoma Open Records Act.\n\nG. The OSBI may prescribe a reasonable fee for processing\n\napplications for identify theft passports by administrative rule.\n\nH. The OSBI shall design the identity theft passport, which may\n\ninclude picture identification.\n\nI. An identity theft passport shall be used only for law\n\nenforcement purposes, including criminal background checks and\n\nsimilar public safety purposes.
