Stat. tit. 22, § 22-305.1","heading":"Deferred prosecution programs - Guidelines - Factors","body":"considered.\n\nBefore the filing of an information against a person accused of\n\ncommitting a crime, the State of Oklahoma, through its district\n\nattorney, may agree with an accused to defer the filing of a\n\ncriminal information for a period not to exceed three (3) years.\n\nThe State of Oklahoma may include any person in a deferred\n\nprosecution program if it is in the best interests of the accused\n\nand not contrary to the public interest. Each district attorney\n\nshall adopt and promulgate guidelines which shall indicate what\n\nfactors shall be considered in including an accused in the deferred\n\nprosecution program. The guidelines shall insure that the State of\n\nOklahoma considers in each case at least the following factors:\n\n1. Whether the State of Oklahoma has sufficient evidence to\n\nachieve conviction;\n\n2. The nature of the offense with priority given to first\n\noffenders and nonviolent crimes;\n\n3. Any special characteristics of the accused;\n\n4. Whether the accused will cooperate and benefit from a\n\ndeferred prosecution program;\n\n5. Whether available programs are appropriate to the accused\n\nperson's needs;\n\n6. Whether the services for the accused are more readily\n\navailable from the community or from the corrections system;\n\n7. Whether the accused constitutes a substantial danger to\n\nothers;\n\n8. The impact of the deferred prosecution on the community;\n\n9. The recommendations of the law enforcement agency involved\n\nin the case;\n\n10. The opinions of the victim; and\n\n11.
